Does immigration enforcement matter? Irregular immigrants and control policies in the UK

Abstract

Between 2004 and 2007 ten countries joined the European Union. Immigrants from these countries who were already in the UK were regularized overnight and subsequent immigrants have been able to work regularly. It might have been assumed that this would curtail irregular migration, yet recent reports suggest that in 2009 there were considerably more irregular immigrants (IMs) in the UK than in 2001 and indeed than ever before. Evidence from the external border of the European Union and the English Channel ports also shows that irregular migration continues.

During this time we have also witnessed major shifts in policy responses. In the 1990s, net increases in immigration coincided with a panic over asylum, which subsequently became the focus of immigration policy. Around 2000, the attention shifted to labour immigration and how to attract much needed workers. After 2004, when the new EU member states, notably Poland and Lithuania, began to supply large numbers of regular labour migrants to the UK, the government became less tolerant toward non-EU and irregular labour migrants. In a relatively short space of time policy priorities and institutions have altered dramatically and underwent constant de/construction. In 2007, the Immigration and Nationality Department became the Border and Immigration Agency, in 2008, this was transformed into UK Border Agency (UKBA), its head was dismissed in 2011 and the agency sub-divided in 2012 into UKBA and UK Border Force. Simultaneously, collaboration between various government agencies has been improved (e.g. UKBA and police cooperation), resources and staffing levels increased (although reduced again in course of funding cuts post 2009) and law enforcement improved and number of operations raised.

So far, research has tended to examine the various factors that explain irregular migration, such as migration systems, asymmetries in economics and the paradoxes of globalisation (macro level), migration networks (meso level) and immigrants' individual survival strategies (micro level). This study aims to uncover aspects that have received little academic attention, namely immigration enforcement, its impact and its limits.

The overarching theme of this study is to examine the impact of increasingly rigid legislation and enforcement measures on irregular migration. In particular we aim to find if and how IMs survive and avoid controls, to investigate the interaction between irregular immigrants' strategies, employer practices and enforcement measures, to understand the political, practical and ethical limits to law enforcement, to identify the impact of enforcement on IMs' access to fundamental rights, show how all this is perceived by the affected immigrant communities, and highlight the impact and effectiveness of enforcement.
This qualitative study builds upon and compares findings with the situation in 1999 and of a previous study by the PI; thus it provides a longitudinal perspective and thereby reinforces a previous ESRC investment.

The following questions will be addressed:
- Which new enforcement measures are introduced and what is their effectiveness? How are service and enforcement balanced? Are there (unintended) side-effects?
- Who are the contemporary IMs, how do they enter, reside and work in the UK and how do they respond to law enforcement? Is there a deterrent effect?
- How do recruitment agencies and employers respond to strict laws and increasing enforcement?
- What is the effect on access to fundamental rights?
- What are the limits of immigration law enforcement?
- How has the situation changed over time?

Irregular migration is a sensitive policy field characterised by tense relations between various actors, limited knowledge, and emotionalised and politicised discourses. This project aims to offer rational views, improve understanding, communication and policy making and shall benefit statutory agencies, the voluntary sector and immigrant communities.

Planned Impact

This project aims to offer new evidence in order to improve understanding, communication and policy making in the field of irregular immigration, immigration law enforcement and fundamental rights. The project will build effective reciprocal and on-going academic-stakeholder relationships, from the research design stage, through to research and subsequent dissemination. Thus, a wide range of users will be involved in the design of the research, regularly updated and benefit from new evidence provided by this project.

First, national STATUTORY AGENCIES, such as the Home Office, UK Border Agency and Department for Work and Pensions, police, local governments, service providers and central government will find this project of benefit. Our research will provide a set of analyses, new evidence, and detailed insights that are not normally accessible by or shared between these agencies. For instance, actors involved in enforcement will gain analysis of the effectiveness, impacts and limits of current measures in order for them to be better informed of the wider picture that will be useful for future policy development. Local governments will be able to better understand issues to do with irregular immigrants in their constituency and shall be supported in identifying the policy implications. Department for Work and Pensions will be given analyses focussed on irregular immigrant workers. Thus, this research aims at aiding policy design, offering standard as well as alternative perspectives. Research results could optimise operations in the view of sensitive enforcement. Research results would also provide advice to principal policy-makers and police officers alike.

Second, the national VOLUNTARY SECTOR in the field of (a) Black, ethnic minority, and migrants and refugee support organisations; (b) human rights/fundamental rights organisations; (c) trade unions, (d) trades councils and employers' associations, and (e) other interest groups will be able to better understand the polices and policy options in this sensitive field in order to shape their responses and interventions. They would also gain information about the position of some of their clients and the needs of this client groups, so that better services and advice can be offered and the situation of the client group improved. Finally, we will discuss with them the impact that immigration enforcement has on immigrant communities in order to make suggestions as to ways of increasing the visibility of community views and concerns at a policy level.

Third, this study, because it is unique, will be of benefit to EU bodies, EU and other national law enforcement agencies, INTERGOVERNMETAL ORGANISATIONS, such as IOM, OECD, and ICMPD and INTERNATIONAL NGOs, like ECRE, PICUM and many others. It shall help to formulate and improve policies in this arena.

Fourth, the GENERAL PUBLIC will be informed through press releases to the media, as well as utilising social media channels such as facebook and a blog in order to activate a non-specialist discussion on this topic.

All users will be approached using targeted DISSEMINATION efforts. A key tool in our strategy will be plain English research and policy briefings of which some will be tailor-made for specific user groups. Progress and results will, within limits, be disseminated through a newsletter and reports made accessible on the project website. Furthermore, INDIVIDUAL MEETINGS will be offered to users at various stages of the project (beginning, in-between and end) to discuss research, findings and its implications, to gain additional feedback, ensure relevance and strengthen the impact of the research and consolidate and extend our user relationships and networks.
 
Description 1. Immigration Enforcement: The project found that since 1998 there has been an ongoing process of legal reform, institutional modernisation and professionalisation of the immigration enforcement regime of the UK. This involved increasing resources (funding, staff) and operations (raids, arrests and removals). However, it also revealed some reverse trend from 2008 due to public spending cuts. Changes in welfare regulations and improved inter-agency cooperation have further restricted irregular immigrants' access to regular service providers (notably in housing, health care, child care, education and legal remedy). However, immigration enforcement staff did not consider immigration enforcement to be well structured and managed; instead, dissatisfaction with constant reforms, management, the media and working conditions was widespread. The evidence suggests that new policies did not reduce the irregular immigrant population; instead, estimates suggest that numbers have increased, at least until 2011. The findings thus question the assumptions, rational and implementation of immigration control and enforcement policies.
2. Irregular immigrants (IM) and employers: IMs responded to this new environment by continuing previous strategies (visa overstaying, working in breach, absconding after rejected asylum applications, fraudulent visa applications and clandestine entry) and developing new strategies (widespread use of false documentation) and tactics (avoiding certain industries, locations, shifts or behaviours) to evade detection. This led to an expansion of criminality - criminal actors involved in trading of false documents were easily available. Two key responses to restrictions to public services were identified: (a) IMs did either not access public services or (b) developed strategies to circumvent restrictions and access such services (e.g. by identifying agencies which do not strictly implement controls, accessing alternative service providers or use of expired statuses or false identities). Overall, on the one hand, some deterrent effect was identified whilst on the other hand, suffering from anxiety and social problems was omnipresent.
Interviews with employers showed a mix of deterrence and resilience but also revealed a moral dilemma. This was caused by the requirement to comply with tightening immigration, tax and labour legislations, pressures from economic downturn and expectations from family and community with regards to providing income and jobs for family and community. Some described their options as either being forced to close down business or continue but disobey the law.
3. Public service (PS) and voluntary sector organisations (VSO): PS staff had mixed perceptions of collaboration with the Home Office. Some appreciate this to tackle what were understood illegitimate users, others rejected such collaboration. Many VSO staff believed that an anti-immigrant environment had emerged, that irregular migration was a social construct and that the criminalisation of migration was pushing vulnerable people underground. Immigration enforcement was widely considered discriminatory whilst restrictions to IMs' access to fundamental public services was condemned.
4. Major achievements: (a) The project gained unique access to immigration enforcement agencies, (b) managed feeding back findings to all relevant stakeholders and thereby developed new channels of user engagement and (d) consolidated a new field of research. In addition, 12 assistants were trained in conducting sensitive research.
Exploitation Route The project has not only contributed fresh data to the study of irregular migration but generated unique data on organisational culture and policy implementation and thus offers new insights into the field of immigration enforcement. Thereby, it facilitates better understanding of policy goals and policy outcomes. It is thus of potential interest to scientists and stakeholders in the fields of migration studies and migration control and generally in policy implementation studies. First, the PI is planning a monograph to inform the academic community of the findings. He also expects at least three journal articles from the staff of this project. In addition, further presentations at international conferences are planned. Second, the revised final findings will be circulated to stakeholders and follow-up meetings arranged, notably with the Home Office and VSOs. Third, a media strategy has been developed and will be implemented to improve public dissemination. As a result, the PI anticipates the Home Office, accountancy agencies (e.g. National Audit Office) as well as voluntary sector organisations to make use of the project's findings and draw policy conclusions. Future research and exploitation may address the policy implications of the findings, the role of the police in immigration control, employers of irregular migrants or explore the proportionality and implementability or the normative dimension of policy goals.

Description Generating impact is still ongoing. So far, the project has raised considerable attention by the media and by other stakeholders. At the beginning of the project expertise was provided to British and international media. Also a meeting was held with the research department of the Home Office. The senior researcher addressed a workshop of Home Office staff and parliamentarians and the participants reported some change of their views. The PI was invited to review and revise an International Organization for Migration (IOM) which shaped and changed a report to the European Commission on health care for irregular immigrants (2016). The PI also attended several meetings of the Brussels-based umbrella organisation Platform for International Cooperation on Undocumented Migrants (PICUM) including a key note to the Annual General Assembly and contributed to shaping the organisation's policy. The PI was invited as consultant to a project of the UN's IOM on migration data and provided an expert report on irregular migration (2016-2017); in addition, he contributed to an international IOM workshop in Berlin and provided a podcast on the same theme for the IOM website. This resulted in another consultation meeting with the director in November 2017 on policy-relevant irregular migration data. In September 2017, the PI was invited to address a panel debate at the migration policy conference Metropolis in Den Haag where he shared the platform with representatives from the Home Office (UK), the Canadian government and the European Commission. In October 2017, the project held three separate stakeholder workshops in London with senior staff of the Immigration Enforcement directorate of the Home Office, public service agencies and voluntary sector organisations. In addition, two individual feedback and discussion meetings were held with a senior staff of the Immigration Enforcement directorate and with two voluntary sector organisations. Also in October, a conference was held which attracted a mixed academic and user audience. Apart from academics it was also addressed by a representative of the Council, of Europe and the international NGO PICUM. Following from this, one of the participants, the Migrants Rights network invited the PI to address a conference in Manchester. The illustrates that the expertise of the PI is recognised internationally by a wide range of stakeholders and shapes their views and policies. In October 2018, a comprehensive research report was launched. This triggered media attention and resulted in a number of interviews and subsequent media coverage. The PI was invited as keynote speaker to addressed the largest international migration conference, Metropolis, where he talked about the limits of deterrence policies. Finally, the report was covered on New Zealand media.

Results and Impact A workshop (Chatham House rules) was held to feed back and receive feedback on the project findings. Seven staff of various Immigration Enforcement Directorate staff fro two cities attended the meeting. This sparked a discussion on immigration enforcement and its limits in the UK. It supported the participants to reflect on their policy and provided them with further insights and arguments and contributed to shaping their practices.
