Victim as Active Participant: Exploring impact of the victim on retributive justice as an active participant within the International Criminal Court

Lead Research Organisation: University of Bristol
Department Name: Sch for Policy Studies

Abstract

The research aims to explore the impact of the active participation of victims within the ICC through legal representation within the court space. The impact will be assessed against the contribution to;
I. Truth seeking
II. Criminal justice procedures and outcomes
III. The delivery of justice
As the OPCV can bring evidence and expert witnesses to the court their role in establishing the notions of truth is key to the research. The role of the victim, via the OPCV, in the procedures and outcomes of the court should provide evidence of their influence over the direction of the proceedings. Notions of justice are complex but necessary in considering the impact of the victim as participant and the aims of the court itself.
