Enhancing access to 20th Century cultural heritage through Distributed Orphan Works clearance (EnDOW)

Abstract

Describe the proposed research in simple terms in a way that could be publicised to a general audience [up to 4000 chars]. Note that this summary may be published on the AHRC's website in the event that a grant is awarded.
Digitization of 20th Century cultural heritage is severely restricted due to the real or potential subsistence of copyright and related rights. Under the new European laws on orphan works, a large amount of cultural heritage whose copyright status is uncertain could possibly be lawfully digitized by cultural institutions on condition that a "diligent search" of the rightholders has been performed. While these diligent searches trigger prohibitively high costs for institutional users, the project designs a cost effective de-centralized system that enables cultural institutions across Europe to source information from end-users and determine the copyright status of works contained in their collections. Ultimately, the project will allow for an enhanced access to 20th Century cultural heritage and will contribute to enable use and re-use of items that would otherwise remain scarcely known and certainly unexploited.
Key objectives of EnDOW are:
? To analyse the legal requirement of "diligent search" across the orphan works legislation of the 15 countries members of Heritage Plus
? To investigate best practices of orphan works clearance across cultural heritage sectors (libraries, archives and museums);
? (Based on this knowledge:) to design, implement and optimize an online platform for crowd-sourced diligent searching on works contained in the collections of European cultural institutions;
? To study the potential applications and challenges of the crowd-based search method for images, film and born-digital cultural heritage works.
Through analytical and empirical approaches to mass digitization, the project will foster knowledge exchange between cultural heritage stakeholders, including small and medium size institutions. It will produce a high-value tool to maximise sustainable management of recent cultural heritage and use and re-use of related cultural artefacts.

Planned Impact

Since this project is mainly aimed at cultural heritage institutions (libraries, archives, museums), the expectation is that the public will deal with works that have a high probability of being orphans (for example old books, pictures and films). Users will therefore perform the costly right clearance exercise in place of the involved institutions, and take the relevant steps required by the competent jurisdictions (e.g., mostly contacting the relevant collecting societies) thus clearing the rights for a large amount of artworks, which will become available for use and reuse by the public at large.
The EnDOW platform, by allowing low-cost right clearance for potentially orphan works is an extremely high-value tool applicable in the short and medium term to maximise the sustainable management of our cultural heritage, by allowing the use and re-use of cultural artefacts.
The outputs of this project will impact on relevant stakeholders in a number of ways:
Working closely with institutions potentially involved in mass digitisation of cultural heritage (libraries, museums, archives) in several countries and delivering capacity-building events (conferences, workshops) will maximize the research outputs through knowledge transfer between researchers, institutions, policy-makers and the public.
The project will also target voluntaries and communities of artworks users and cultural heritage preservation NGOs, which will find in EnDOW a vehicle to fulfil their mission and to maximise their achievements.
Strongly promoting interaction among stakeholders (cultural heritage institutions, academic and no-profit institutions that manage online databases, collecting societies, and the public) will ultimately enhance the dissemination capacity of public institutions and hence public access to cultural heritage artefacts, which in turn will allow further transformative cultural production.
To policy-makers, the project will provide pioneeristic solutions to difficult and costly problems, which could later be implemented in other domains. It would serve as a model on the much-debated problem of centralised mass licensing which has hitherto absorbed large investments and it is recognised as a crucial engine for the knowledge economy.
To private stakeholders the project can offer an unprecedented testing environment for a new business model, which applies the power of crowd-sourcing to mass licensing of intellectual assets.
In conclusion, EnDOW will provide cultural institutions and private stakeholders with unprecedented tools to address the problem of mass digitization, and in particular of right clearance on large scale. This experience has the potential of being further expanded, ameliorated and employed by public and private stakeholders within and beyond the domain of cultural artefacts. This technology will be available on an experimental basis (beta version) at the end of the second year of the project, and it will be available to the public at large at the end of the project. It will be therefore usable in the short to medium term. The high value of this platform is self-explicative: it will substantially erode the costs of mass right clearance without any evident drawback.

Description The main goal of EnDOW is to facilitate the task of copyright clearance for cultural heritage institutions engaged in the digitization of their collections. Copyright clearance is a difficult and time-consuming process. The main idea is to develop an online tool that can be used by a non-specialized audience to help cultural institutions to carry out the process. Legally speaking, the process crucially involves a "diligent search" of the possible copyright holders. Our project has streamlined the diligent search process, it has tailored it to different categories of works (such as books, journals, audio and audiovisual works) and it has made it applicable to 20 different countries of the EU (in each of which there are different legal requirements). The result is a set of 60 flowcharts of operations, that in the next months will be implemented in an online interactive platform.

The project has identified a number of pitfalls and issues in the current legislative framework. In particular, the fact that a high number of sources and databases that must be consulted in the course of a diligent search are not available to the public. In the 20 countries we have examined, on average 36% of sources are not freely accessible online. However, failing to consult these sources while carrying out a diligent search may result in copyright infringement - a risk that many cultural institutions are not prepared to take.

In May 2018 the Diligent Search Tool has been launched (http://diligentsearch.eu/diligent-search-tool/). The Tool enables users with no legal knowledge and experience with copyright clearance to carry out diligent searches on works. The Diligent Search Tool walks the user through the necessary steps of a diligent search. Users are requested to provide information and to answer questions regarding the work and its possible right holders. To respond to some of the questions, users may need to search appropriate external sources, as per the instructions given by the Tool. At the end of the process, users will be able to determine whether the work is an orphan work under the Directive 2012/28/EU law as implemented in the country where the work is located. The downloadable search report can be used by any eligible Institution to record the work to the Orphan Works Database at the European Intellectual Property Office.
The Diligent Search Tool is available in 4 languages: English, Dutch, Italian and Lithuanian.
Exploitation Route The findings reported in Report 1 will serve as a basis to design the Beta version of the diligent search platform (which is the main Deliverable of the project). However, the findings have also independent policy significance. In our study, which was conducted in three countries (UK, Italy and Netherlands), we reveal that carrying out a Diligent Search may require consultation of an overly high quantity of diverse sources of information. Most importantly, our analysis shows that a sizeable share of these sources is not easily accessible or, even, not accessible at all. The study also suggests a possible solution to this problem that involves soft-law intervention to establish hierarchies among sources for Diligent Search, with a diversification between compulsory and optional sources, depending on their relevance and accessibility.
The Diligent Search Tool enables cultural institutions across the EU-28 to carry out legally valid diligent searches on orphan works. Mayor European cultural Institutions such as BFI, the British Library and EYE are using the Tool as part of the copyright clearing process required to make works available online.

Description The flowcharts of operations to carry out diligent searches for orphan works in 3 jurisdictions have been considered by a number of cultural heritage institutions, including BFI, the National Register of Scotland, the Library of the University of Glasgow, the National Library of Luxembourg, the National Library of the Netherlands, to carry out pilot projects on digitization of orphan works. Our analysis of diligent search requirements in 20 EU Member States has been used by the EU Intellectual Property Office (the EU agency with responsibility for the orphan works database) to inform national authorities that are in the process of establishing guidelines for diligent search. We have been invited by the UK Intellectual Property Office to present evidence on the functioning of orphan works legislation in two occasions: 1) in relation to the submission by the UK government of an observation in the case Soulier & Doke (European Court of Justice, case C-301/15) and in the framework of a consultation on the proposed new copyright directive in the Digital Single Market. The National Library of Lithuania has contacted the research team in September 2018 with a request to collaborate in a project on orphan works clearance. The Library has offered the translation of the entire flowchart of operation and annex information in Lithuanian, so to enable the personnel of the Library to carry out diligent searches and register the works on the Orphan Works Database of EUIPO. The Lithuanian version of the Tool has been implemented and published in October 2018. The Diligent Search Tool (see under "Software") has been mentioned in a session of the Dutch Parliament in June 2018 as an example of how technology can help cultural heritage institutions (in particular the National Film Archive of Netherlands - EYE) to overcome the burden of clearing copyright in orphan works. In December 2019 the European Commission has launched a call for tender for a Study on the application of the Orphan Works Directive (2012/28/EU) (SMART 2019/0042). The call cites the outputs of the EnDOW project as key resources to the taken into account by the tenderer.

The context of this study is Article 10 of the Orphan Works Directive, which requests the Commission to submit to the European Parliament, the Council and the European Economic and Social Committee a report on the application of the Directive, in the light of the development of digital libraries. The call for tender requires consideration for the outputs of the EnDOW project in three respects: p. 14: "The set of information used for this task should include [...] the final reports of the EnDOW project" p. 16: "The study should also examine possible options to improve the application and effects of the Directive, by looking for example at [...] proposals to streamline the diligent search procedure of Article 3, so that beneficiary organisations focus their activity of digitising orphan works and not on performing the diligent searches. Collaborator Contribution For the EnDOW Community Project the BFI will work with Bournemouth University to build on work to date by identifying a collection and/or titles for rights research and clearance using the EnDOW platform, creating a dataset of rights-cleared orphan works that will be able to be published on one or more of the BFI's online platforms. The BFI will seek engagement across the wider film archive sector, especially its partner National and Regional film archives and through the wider network of Film Archives UK Copyright Group for inclusion of additional film collections and to develop a crowd-clearing community and to provide an example for other cultural heritage organisations on how to use the platform. Using real-life examples of collections/titles will enable the capturing of the challenges of the Diligent Search process. The BFI will reach out on social media and other sector networks to raise awareness of the project and the incentives for engagement with crowdsourcing.

The event included discussions on legal regulation and practices, in order to explore impacts and policy implications innovative for the problem of orphan works within the EU. Results and Impact A virtual launch event was held on Wednesday 18th November from 4 pm.

EnDOW is a project launched in 2015 to help cultural institutions digitise "orphan works". These are works protected by copyright, but whose rights holders are unknown or cannot be located. A huge wealth of cultural artifacts (writings, films, sound recordings etc.) that can only be lawfully digitised and made available to the public after a "diligent search" of the copyright owners has been performed. A burdensome process, for which many cultural institutions lack resources and expertise.

To help cultural institutions, EnDOW has developed the Diligent Search Tool (http://diligentsearch.eu): a public and freely accessible resource that facilitates the task and allows users with no specialized knowledge of copyright to participate in the diligent search process. By engaging users, cultural institutions can reduce the costs of diligent search by up to 200%.

EnDOW Community and the BFI

The aim of EnDOW Community is to engage an online community of volunteers to perform diligent searches on audio-visual works held by the BFI and other UK Regional film archives. Film lovers of any age and background can take part in this project. Thanks to this army of volunteers, at the end of the project a new collection of audio-visual works will be included in the UK Orphan Works Register and it will become available on the website and YouTube channel of the holding institution.

Lastly, the knowledge acquired by clearing the rights of films owned by BFI and other UK Regional film archives will give the chance to extend the use of the Diligent Search Tool to other cultural artefacts, in a potentially infinite process of freedom of artefacts belonging to different cultural heritage sectors.

Results and Impact This manual provides information for common users on conducting a diligent search to find right holders of potential orphan works via the tool on diligentsearch.eu. The tool is designed to guide users through the diligent search process for literary, audiovisual and musical works located in EU countries. To this end, the manual briefly clarifies when and why you as a user of cultural content may generally be confronted with copyright law (par. 2). The more specific concepts of 'orphan work' (par. 3) and 'diligent search' (par. 4) are characterized thereafter. Next, the search process is briefly explained (par. 5), followed by an instruction of the use of the tool (par. 6). A selection of copyright concepts that can come up during the search is further defined (par. 7). The manual concludes by indicating the steps that follow the search if an orphan has been identified, namely, registering the work as such (par. 8) and its permitted uses (par. 9).

Results and Impact EnDOW ("Enhancing access to 20th Century cultural heritage through Distributed Orphan Works Clearance") is a collaborative project funded under Heritage Plus, a programme launched by agencies of 18 European countries and the European Commission as part of the Joint Programming Initiative in Cultural Heritage and Global Change.The EnDOW Diligent Search Tool enables users with no specialized legal knowledge to carry out diligent searches on behalf of cultural heritage institutions. The tool is now available in Beta version (with limited functionalities) for searches in the 20 countries participating in the study.

Results and Impact A workshop on "Orphan works & Rights clearance" was organized by EnDOW researchers and associate partners Maurizio Borghi, Marcella Favale, Aura Bertoni and Annabelle Shaw (BFI) as part of the CREATe Festival 2016 "Copyright & the future of digital creativity". The workshop focused on the orphan works legislation, addressing the main hurdles that cultural institution have to face when carrying out a diligent search of rightsholders. The interactive workshop engaged the public in practical diligent search exercises, the outcomes of which were subject to panel discussion.
