The repatriation of competences: implications for devolution

Abstract
The devolution settlements in the United Kingdom have been embedded in UK membership of the European Union. Policy areas like agriculture, the environment, fisheries, regional development and justice and home affairs, are both matters for the devolved parliaments and also areas that fall under the authority of the EU. In these policy fields, the EU has provided a common framework that has limited the degree of difference that has emerged within and across the UK, and this has helped keep the nations of the UK together. Whichever model is reached after negotiations, the UK's withdrawal from the EU will affect the powers of the devolved nations in complex ways. It may lead to further decentralisation of power to the devolved institutions. Alternatively, it could lead to powers being recentralized within UK-wide institutions. A third possibility is that it could see the setting up of new forums and process to enable the UK Government and the devolved governments to cooperate more closely on policy areas where their powers overlap. The outcome of the negotiations, and the decisions taken by key actors, will have consequences for the powers and responsibilities of institutions in the devolved nations and their relationships with the rest of the UK. This project will carry out a study of these developments as the Brexit negotiations get underway, and we will examine how the outcomes will shape devolution and relations between the UK's four governments. We will study and support the role of parliaments in scrutinizing the Brexit negotiation processes and the outcomes. We will meet with civil servants to help them understand the effects of different Brexit options on devolution in Scotland, Northern Ireland and Wales. Our project will focus on three particular areas of devolved policy - agriculture, the environment and justice and home affairs - to investigate the particular consequences of bringing powers back from the EU to the UK after Brexit. We will work with professionals and representatives from these sectors to help them prepare and plan for Brexit under different scenarios. We will also enhance broader understanding of the process, outcomes and their impact on devolution by producing easy to read and easy to access explanations, analyses and reports, and by taking up opportunities for commenting in the media.
Planned Impact
We have four impact objectives: to inform broader understanding of the impact of Brexit on the scope and dynamics of devolution within the UK; to enhance parliamentary oversight by providing briefing materials, evidence and advice to relevant parliamentary committees as they scrutinise the negotiation process and outcomes; to support officials in developing their understanding of the effects of Brexit on the distribution of competences and intergovernmental relations within the UK; and to support key stakeholders in three policy sectors - agriculture, the environment and justice and home affairs - in understanding the interface between Brexit and devolution in their sector. In addition, we have an over-arching objective of enhancing the profile and research impact of the UK in a Changing Europe initiative among key audiences across the devolved territories.
Our engagement activities will build upon the three years of experience and knowledge exchange conducted by the Centre on Constitutional Change (CCC), within which all members of the project team collaborated. We will match this to the expertise, networks and platform of the UK in a Changing Europe initiative. Activities will respond to events and opportunities as they unfold, but will include five academic-practitioner workshops on (i) Brexit, devolution and agriculture; (ii) Brexit, devolution and the environment; (iii) Brexit, devolution and justice; (iv) Intergovernmental relations after Brexit; (v) Brexit, devolution and EU relations. The latter will be targeted at officials and academics from beyond the UK. Each of these will lead to a substantial research report which will be disseminated widely among target audiences, and used to provide further, more tailored briefings to specific organisations.
We have identified five target research users: parliamentarians; government officials; ambassadorial and consular staff; policy stakeholders; and the public. We will engage with parliamentarians across the UK, in Ireland and the EU to inform their understanding of the effects of Brexit scenarios on devolution, and enhance their capacity to scrutinise governmental action. We will provide them with advance notice of new findings, oral advice as well as written briefing papers, and a private space for governments individually or collectively to subject ideas and proposals to independent evaluation. We will exploit regular invitations to inform diplomats, politicians and judges from the EU and beyond about the implications of Brexit for constitutional and territorial politics within the UK. We will support professional stakeholders in our three policy sectors to prepare and plan for different Brexit scenarios, and to evaluate the impact of Brexit outcomes on policy and finance within their sector. Building on our extensive experience of conveying complex ideas in fresh, clear and accessible styles, without compromising impartiality or academic authority, we will disseminate our findings in blogs, briefing papers, short reports, podcasts, Twitter feed, media commentary and analysis in print and broadcast media across the UK and internationally. The latter will include specialist sector-focused programmes and publications, newspapers, and more popular outlets such as radio phone-ins and prime time TV programmes.

Still better together? Purpose and power in intergovernmental councils in the UK

Description | Our research questions were designed to assess the effect of the repatriation of competences on devolution and multi-level government. We examined the options for the reallocation of competences and their effect, the process of negotiations. Our original intention was to examine the substantive outcome once it is known. Given that, at the end of the project, Brexit outcomes were still not known, we explored the potential effects of different Brexit scenarios. Our research questions and findings are set out below. 1.What is the extent of overlap between devolved and Europeanized competences? The team examined the repatriation of competences in three key policy fields. In each case, we identified considerable overlap, most acutely in the case of agriculture, given the dominant role of the EU Common Agricultural Policy to date. Yet, even the CAP has afforded flexibility to the devolved governments in how it is implemented. This room for manoeuvre may be constrained if the repatriation of competences generates pressure (from central government) for UK policy uniformity within common legislative or non-legislative frameworks, as appears to be the case. The work on justice and home affairs explored the extent to which the UK has opted out, and opted in, to EU JHA frameworks, the intergovernmental coordination this has necessitated within the UK, and the effects on devolved competence in justice, policing and security of alternative Brexit scenarios. In energy and climate change, we explored how EU regulatory frameworks, EU finance and the support for trade within an internal energy y and carbon trading market have shaped and incentivised policy development across the UK. It examined what commitments made in the Withdrawal Agreement and the backstop would mean for climate and energy policy at the UK and devolved level. 2. What are the options for allocating competences and resources under Brexit, and what would be their implications? We gave considerable attention to examining the complexities of the EU (Withdrawal) Bill, concluding that, in its original form, it marked the first significant recentralisation of power within the UK since devolution. We charted the amendments to the Bill and reviewed their effects on devolved competence, noting the 'soft power' that the devolved governments were able to exert in securing a less restrictive approach to devolved competence, and the degree of collaboration between the Scottish and Welsh governments. We analysed the Continuity legislation in the Scottish Parliament and the National Assembly for Wales, designed to prepare the devolved statutes for Brexit without undermining devolution, noting the complexities they would have engendered. We examined the subsequent fate of these: the Scottish bill was rendered largely beyond competence by protections written into the EU Withdrawal Act (as confirmed by the UK Supreme Court after a landmark referral by the UK Government); the Welsh Act was repealed after the Welsh and UK Governments reached an intergovernmental agreement on the scope and limits of the withdrawal legislation vis-à-vis devolved competence. We also explored the fate of the Sewel Convention, a key constitutional convention underpinning of the devolution settlements which has been tested by the domestic Brexit process. As a result, the conventional foundations of devolution have been destabilised. 3. To what extent do devolution/territorial issues feature in the Brexit negotiation process, and what influence have the devolved governments been able to exert? The extent to which UK-EU Brexit negotiations have been dominated by one territorial issue - the Irish border issue - has been striking. This has been against the backdrop of the continued breakdown of devolution in Northern Ireland and the political alliance between the Democratic Unionist Party and the UK Conservatives. Other territorial issues have had low prominence in UK-EU Brexit negotiations, with little opportunity for the devolved governments to influence the UK negotiating line. By contrast, the domestic implications of Brexit have led to an intensification of formal and informal intergovernmental relations (IGR), which have exposed both the opportunities for, and the limitations of, cooperative working across the UK's internal jurisdictions. IGR have also revealed a lack of common understanding between the institutions as to the scope of devolved powers, and a lack of mutual trust between the UK government, on the one hand, and the devolved governments on the other. On the other hand, some informal working, especially on Common Frameworks, is helping to build trust and cooperation, at least among officials. |
Exploitation Route | We have been engaging with the UK and devolved governments, and with relevant parliamentary committees in Westminster, the Scottish Parliament and the Senedd, throughout the research project with a view to informing understanding of proposed legislative changes on the devolution settlements and intra-UK territorial relations. These contributions have aided the process of parliamentary scrutiny, for example, by generating understanding of key issues among members, supporting members in questioning witnesses, and informing committee recommendations. We have also supported officials in thinking through what different options may mean for their governments and for the UK's territorial constitution, including through providing clarity on 'common frameworks' and what forms these can take, and raising issues about how these may be underpinned and subsequently governed. We have supported a range of policy stakeholder about the potential implications of Brexit for their sector. |

Description | We have enhanced parliamentary scrutiny of Brexit legislation and the Brexit process more broadly. This has been achieved through advisory positions in the Scottish Parliament and the House of Lords, which have helped to shape members understanding of key issues, improved their ability to ask question of key witnesses and hold government to account, and shaped the production of committee reports. We have also helped other committees in Westminster, the Scottish Parliament and the National Assembly for Wales in scrutinising Brexit legislation and Brexit developments, through witness testimony that has informed parliamentary reports. The broader issues of Brexit legislation for the UK territorial constitution were discussed in an evidence session by Keating at the European Parliament. We also wrote briefing papers for parliamentary committees and researchers, and numerous blog posts at key stages of the Bill's progress, as well as articles and book chapters. Although the Brexit process continued beyond the completion date of the project, we were able to use our research findings to provide commentary and analysis of events as they unfolded, in the form of blogs, witness testimony, media commentary and public presentations. McEwen worked with Scottish parliamentary officials and committees to set up an Expert Advisory group on the constitution, to foster academic-parliamentary engagement and ensure that the parliament's legislative and scrutiny functions were informed by academic research. We have worked with government officials to develop mutual understanding of the implications of Brexit and the repatriation of competences for the devolution settlements across the UK, and to shape their understanding of options for common policy frameworks and intergovernmental coordination. We have discussed the ongoing issues in devolution masterclasses delivered at the Foreign and Commonwealth Office, DEXEU, and the Scottish Government, and in private meetings with officials from the Treasury and the Cabinet Office, as well as the Welsh and Scottish governments. The PI was subsequently invited to undertake a secondment in the Scottish Government to support its work on intergovernmental relations. The system of IGR has been widely regarded as 'not fit for purpose' in light of the effects of Brexit on devolution. As detailed in the submission, the secondment contributed to shaping the Scottish Government's policy, strategy and capacity to engage effectively in IGR. We have helped inform understanding among policy stakeholders, especially in agriculture, energy, justice and home affairs and the 'internal market' of the likely effect of Brexit and alternative Brexit scenarios for their sector. The team has been involved in a variety of public events, including panel discussions as part of the Edinburgh festivals, at party conferences, and at community-focused events. We met with visiting dignitaries and delegations from China, India, Taiwan, Canada, Spain (Catalonia), the United States, the Netherlands, Ireland and Germany seeking to learn about how the process of Brexit is challenging the unity of the UK. We accepted invitations to speak to government officials, think tanks and academic forums in Canada, Spain and Italy to discuss the territorial dynamics of Brexit within the UK. We gave media interviews to national and international print and broadcast journalists on key aspects of the Brexit process and their effect devolution and territorial dynamics. We incorporated into our analysis the significance of the campaign and outcome of the UK snap election for the domestic Brexit process, the balance of power between key political players, and the dynamics of intergovernmental negotiations. The team worked closely within, and actively promoted, the UK in a Changing Europe programme and its Director, Anand Menon. As PI, McEwen co-designed and hosted a workshop bringing the Scottish Government together with the policy-focused Brexit priority research grant-holders for a private discussion on the intersection between Brexit and devolved policy. McEwen and Menon delivered fringe meetings at successive SNP annual conferences. McEwen organized a public conference in Edinburgh on behalf of the UK in a Changing Europe, involving the Directors of both UKiCE and the related Governance after Brexit programme, the Deputy Director of UKiCE, a cross-party panel of politicians and a keynote address by the Cabinet Secretary. This was followed by a private session with senior officials. The PI and Co-Is participated in showcase events and workshops organized by the UKiCE programme, including giving keynote contributions at the annual conference, and contributing analyses for landmark publications following the triggering of Article 50 and the 'One Year On' publication. |
