Transnational Organised Crime at Sea: New Evidence for Better Responses

Abstract

The maritime dimension of transnational organised crime continues to be one of the least studied areas of international security studies and criminology. Maritime security has climbed high on the international agendas, as for instance documented by the UK's first maritime security strategy from 2015, or events such as the annual Our Oceans Conference that has included maritime security in its discussion. Yet, evidence on transnational organised crime at sea that can inform political and security responses on a national, regional or international level remains weak. This concerns in particular how different maritime crimes, such as piracy, illegal fishery, or smuggling relate to and reinforce each other. Such knowledge is not only vital to protect maritime zones and safeguard maritime borders, but also to ensure the freedom of navigation and safety of shipping. In the global South, it is also a vital element in achieving the Sustainable Development Goals through advancing the so-called blue economy.

In order to improve our evidence basis in this field and to develop new guidelines for international responses through law enforcement operations, surveillance, or capacity building, this project is the first to develop a comprehensive evidence base on transnational organised crime at sea and the responses to it with a focus on the Indo-Pacific. The project, firstly, cross-fertilizes in a path-breaking way existing research on maritime crime from different disciplinary backgrounds and data sources to develop an evidence base for analysis and policy making. Secondly, it is the first to compare three sub-regional maritime security governance systems with each other. Through studying maritime security governance in the Western Indian Ocean, Southeast Asia and the South Pacific the project offers major new insights into how maritime crimes as paradigmatic transnational security problems lead to new forms of international cooperation. Thirdly, the project will develop essential guidelines and an outline of best and promising practices for how to tackle maritime crime. Drawing on the insights gained from each region, we identify those responses which are particularly promising to be replicated in other regions and describe how to do get these practices in place.

This is the first major research project which not only consolidates existing knowledge on maritime crime, but also develops new insights on how they can be addressed and prevented on a regional and transnational level. The ground-breaking results of the project will open new avenues for research on maritime security and global ocean governance, but also new innovative policy ideas for how to prevent crimes and assist countries in the Global South in doing so.

Planned Impact

This project provides the first systematic collation of evidence on transnational organised crime at sea, the relation between different forms of crime, and a comparison of the institutional responses in three regions. Three of the outputs are explicitly tailored to practitioners and will be developed in close collaboration with them: The TOCAS Evidence Base, the Regional Institutions Guides and the Promising Practices Guide.

These outputs are tailored for four beneficiary groups:

1) Maritime security policymakers from the regional countries, such as staff of ministries of transport, trade, or interior, maritime and port authorities, or parliamentarians.
2) Practitioners involved in maritime security operations, such as analysts and senior leadership staff of coastguard, navy, marine police or prosecutors.
3) Diplomats representing their countries at regional maritime security meetings, such as the maritime security focal points of the Djibouti Code of Conduct, or heads of maritime security divisions in Ministries of Foreign Affairs.
4) Staff working in the design and implementation of capacity building project, in organisations, such as the UNODC's Global Maritime Crime Programme, or the IMO's Maritime Security and Facilitation Division.

How will they benefit?

The TOCAS Evidence Base (a systematic review, an annotated bibliography, an overview of maritime crime resources and a Wikipedia review and update) is designed to become the go to source for existing data and analysis of maritime crime. It will aid the four practitioner groups in tasks such as preparation of policies, speeches, training courses or educational programmes, and also introduce newcomers to the problems of maritime crime.
Regional Guides, one for each region, are designed to help practitioners, in particular groups 3 and 4, to cope with regional institutional complexity. Practitioners involved in one institution are often unaware of what is happening in others. The reasons for this are manifold, the sheer complexity of transnational maritime crime, with different governmental bodies dealing with it -one ministry might be involved in one initiative, and one in another -, and different professions (defence forces, fishing regulators, law enforcement, or conservationists) addressing it. The outcome is a high risk of duplication, overlap and potentially even competition between institutions and the lack of awareness for synergies (for instance, in information sharing). The regional guides intend to address this problem by providing detailed institutional profiles in each region and delivering options for how the institutions might form an institutional architecture and how synergies can be utilised.

The Promising Practices Guide, outlines promising practices from the three regions and is designed to facilitate inter-regional knowledge transfer and cooperation on maritime crime. It responds to the observation that in each region there are particularly promising and noteworthy practices, which are often not known in other regional environments. The Guide intends to resolve this and provide a major resources for ideas and innovative practices of how to handle challenges, such as information sharing, transfer of suspects, or tasking of shared assets.

What will be done?

As described in the Pathways to Impact, representatives of each core practitioner groups are partners in all stages of developing and implementing TOCAS. Additional key individuals will be integrated through three regional workshops. Draft versions of the guides will be reviewed by these individuals. The guides will be disseminated at a closing practitioner symposium. In addition, project activities and results will be promoted through the existing SafeSeas.net website and mailing list, and via a dedicated Facebook and twitter account. Two surveys, three months and one year after the symposium, ensure that impact is measured and guaranteed beyond the lifetime of the project.
 
Description The TOCAS project focuses on transnational organised crime (hereafter 'blue crime') in the Indo-Pacific. It asks three core questions:

1. What do we know about blue crime?

In 2019-20 we conducted a comprehensive cross-disciplinary review of academic, NGO and policy literatures on blue crime. The results are summarised in the SafeSeas evidence base at www.safeseas.net. We show how different types of blue crime interconnect around: a) Organisational, material and skills demands; b) Geographic spaces; c) Shared forms of criminal enterprise and business practices. Maritime criminals often shift from one crime to another, or from licit to illicit activities, according to changing calculations of risk and opportunity.

In a mapping exercise conducted in the 2020-21, we identified 65 entities or initiatives that collect and process international data on blue crime, including international, regional, and non-governmental organisations. We found significant variations in data quality by issue and region. Data collection tends to be compartmentalised by issue. Quantitative data dominates, focusing on patterns and trends rather than networks, interlinkages, and root causes. There are also issues of comparability across datasets due to different data collection methodologies.

2. How are international and regional actors responding to blue crime?

In 2019, we developed a five-stage theoretical model of how transnational cooperation has developed around the shared problem of blue crime. The model shows the role of informality and experimentation in facilitating cooperation between stakeholders, a process we call 'pragmatic ordering'.

In 2020-21, we conducted an analysis of regional maritime security arrangements (RMSAs) in the Indo Pacific. 112 RMSAs were surveyed across 20 data points. We found a significant expansion of these arrangements since 2010, with 31 in the Western Indian Ocean subregion, 54 in Southeast Asia and 27 in the South Pacific. Of these 40% were formally organised while 60% operated on an informal or ad hoc basis. 80% were donor dependent or internationally led, with a general trend of widening mandates across issues. Key activities include coordination and deconfliction, maritime domain awareness and information sharing, capacity building, and maritime security strategy development.

Our analysis shows dynamics of cooperation and fragmentation amongst these bodies. Informal forms of organisation have created opportunities for cooperation between diverse coalitions of actors, as well as the development of novel responses. However, there is also duplication of activity between RMSAs, as well as sometimes competition and even contradiction. These create opportunities for forum shopping amongst actors and can undermine collective action and problem solving.

3. How can these responses be strengthened?

Blue crime is a problem of both land and sea. It incorporates issues of enforcement and policing, but also sustainable development in coastal communities, criminal organisation on land and the role of - often external - markets in driving the demand for illicit goods. Responses to blue crime should be widened to include action in these areas too, including criminal investigation on land, coastal livelihoods development and action to tackle external drivers at home. Regional coordination and data collection efforts should be better harmonised and strengthened to better inform these responses.
Exploitation Route The TOCAS research outcomes can be taken forward by academic and non-academic audiences. The academic contributions of the project are threefold.

1) Our work provides the first systematic categorisation, evidence base, and analysis of transnational organised crime at sea and responses to it. In so doing we contribute to the emergent field of blue criminology and provide a conceptual and empirical baseline from which other research can work;

2) It provides new theoretical insights into how diverse coalitions of actors develop collective responses to shared problems. Our five-stage model of pragmatic ordering is relevant not just to maritime security and the problem of blue crime, but other issue areas such as transnational terrorism and cyber security;

3) The research provides the first comprehensive analysis of the toolbox of the maritime law enforcement responses, including informality and experimentation, operations at sea, maritime security strategies, maritime domain awareness, and capacity building. In each case we provide foundational baseline analysis from which further work can be conducted.

Our work is also relevant to non-academic stakeholders. It enables policy makers and professionals to make sense of the complexities, challenges, and interlinkages of blue crime, while providing guidelines and best practices for developing future response. In the UK, the TOCAS team has worked closely with the UK government, and particularly the Department for Transport in developing the 2022 UK National Strategy for Maritime Security (NSMS) with emphasis on the UK's so called 'Indo-Pacific tilt'. Edmunds and Bueger held five consultative meetings with the DfT on strategy development. We also organised two high level, cross-departmental expert workshops on the NSMS in February 2020 and March 2022. The DfT drafting team drew extensively on our research findings and published work when drafting the strategy. TOCAS PI Edmunds also had direct input into the NSMS text. In November 2022, James Driver, Deputy Director of the Maritime Security Division of the DfT, wrote that 'the now published [NSMS] is the result of collaborative work from across academia, industry and government, [and] this would not have been possible without your support', and that the collaboration with the TOCAS team was 'a significant factor in helping us explore some key issues which helped shape our thinking in terms of coverage, and direction of our strategic thinking and development of the final product.' 3. Beyond the UK, the research programme has also informed the operational agenda of international organisations involved in maritime law enforcement and capacity building with third countries. The Director of the UNODC Global Maritime Crime Programme wrote that the results of the research 'have a major impact in the regional discussion to raise more awareness for maritime crime, how it can be addressed and what forms of capacity building are available' and have 'provided very useful ideas and guidance for our work'. Research findings and publications from the TOCAS team are in widespread use in national and international maritime security capacity building and law enforcement programmes. A Project Manager at EU CRIMARIO noted that 'recommendations provided in [the BPT] have been instrumental in the process of supporting Mauritius when drafting their maritime security strategy'. CRIMARIO also endorsed the BPT on its website, noting that it 'provides an essential guide for the planning, programming and implementation of capacity building for maritime security'. The UNODC and EU CRIMARIO have integrated the research findings from the TOCAS project into their own maritime security training programmes, as has the Geneva Centre for the Democratic Control of Armed Forces (DCAF).

Collaborator Contribution The UNODC will facilitate inter-regional and intra-regional discussion on maritime security. They agreed to support convene regional discussions with the assistance of our programme offices in Nairobi, Colombo and Bangkok, and also to assist in convening the main symposium to facilitate the discussions across regions. Unfortunately these activities were unable to go ahead due to the COVID-19 pandemic. However, we maintain an ongoing dialogue with the UNODC's Global Maritime Crime programme on the findings of the research.

Results and Impact Hosted an Ideaslab which involved a number of significant UK-based maritime security policymakers, including from Joint Maritime Security Centre, Foreign and Commonwealth Office, Scottish Government and Department for Transport. The purpose was to bring everyone together to think on core aspects surrounding British maritime security, and drew on the TOCAS research. The TOCAS Evidence Base was also soft launched at the event, due to the extent of relevant stakeholders. Had multiple impacts, the strongest being requests for further opportunities for discussion from attendees, as well as changes in thinking reported in a post-event survey.

Presented on TOCAS to a group including maritime security actors such as the Navy, Coast Guard, National Security Council, etc. Also facilitated small break out sessions of these actors to think more about their role in maritime security governance, especially related to TOCAS. The College and DCAF have since expressed interest in doing a second workshop focusing more on TOCAS (rather than maritime security more generally).
