The Devolution of Legal Powers to Wales in the Context of the UK's Membership of the European Union

Abstract
What will it mean for the law in Wales if the decision is taken for the UK to leave the EU? And if it decides to stay?
Over the past two years, the UK Government has undertaken a review of the way in which powers are shared between the EU and the UK, across the range of policy areas in which the EU can act. The purpose of the Balance Of Competences review is to assemble a body of evidence to help decide whether or not continued membership is in the UKs national interest. But the consideration of what is in the national interest may look very different from Cardiff, Belfast or Edinburgh than it does in London. Devolution has meant that the devolved administrations have the power to adopt their own laws on certain matters, and differences are starting to emerge across the UK in the laws that may apply. Policies may have very different impacts across the different regions of the UK.
To adopt its own legislation, Wales, as with the other devolved powers, needs to have been given the competence to do so. It also has to ensure it is complying with the requirements of EU law when it legislates. Whilst there may be (un)popular images of EU law requiring exactly the same rules to be applied across all the countries of the Union, scope for differences certainly exist. The purpose of this project is to examine the Balance of Competences review from the perspective of devolved power. Does the account of the law, and of who does what, in the review, clearly reflect what is in the competence of the devolved administrations, and what remains in the power of the central UK political institutions? Is it clear from a devolved perspective what the consequences of any returning of legal powers to the UK from the EU would be? When would Wales be able to maintain the laws it already has, and when would this only be possible if a new devolution settlement was agreed? Could, legally, Wales be able to do what Plaid Cymru leader Leanne Woods suggests when she argues that 'If powers are to be repatriated, there should be specific attention as to which parliament takes up those repatriated powers, and not the automatic default that everything goes to Westminster. For example, on social measures, Wales should be allowed to 'opt-in' even if England chooses not to do so.'
The project will seek to bring clarity to the allocation of legal competences, and highlight the manner and extent to which the relationship Wales has with the EU is shaped through the machinery of Westminster and Whitehall. As well as offering impartial independent explanations of the legal frameworks that apply across a number of key policy areas, the programme will also undertake new research on the way the interests and concerns of the devolved powers may be fed into the EU decision making process. This is through an investigation into the recently acquired powers for national parliaments to make representations to the EU Commission that proposed laws should be handled at a national or regional level instead of at EU level, as their objectives can be achieved without the need for EU legislation. The research will explore how this 'subsidiarity review' is operating within the UK, looking at the relationship between the Welsh Assembly, the other devolved parliaments, and the UK Parliament.

| Description | The original Senior Fellowhsip (SF) project was set up to look at the issue of where decision making powers currently exercised at the EU level will return to on Brexit. Would this be to Westminster and Whitehall, or, where the policy areas fall within devolved competence, to the executives and legislatures in Cardiff, Edinburgh and Belfast? The issue was identified as a legally and politically significant one, playing out against the existing devolution settlements. Answering the question in strict legal terms involved an assessment of the scope of devolved competence and its overlap with EU policy areas and instruments. Bringing added complexity was the change in the underpinning model of competence allocation to Wales - our primary focus -from a conferred to a reserved model. Alongside its legal significance, the political salience of the project became heightened as the UK Government attempted to reassert control over these areas of overlapping competence. A series of policy-specific reports were produced from 2016 providing an initial assessment of the competence issue. These also raised broader political, economic and policy considerations. By the end of the funding, we had also produced a more detailed fine-grained assessment, in a grid extending over 100 pages, providing a degree of detail not found in other assessments of the competence issue. From 2017, attention focused on the legislative and intergovernmental approaches adopted to manage the return of competences and their exercise in a post-Brexit UK. The analysis has been comparative, in that the protections offered for devolution and the voice of the devolveds in governance processes as provided for in an EU context are taken as a base line for comparison with the proposed replacement domestic regime. The constitutional significance for devolution of the EU (Withdrawal) Act 2018 became a particular area of expertise, which was shared with a range of target audiences. Work under the SF has been significant in opening up as a research theme the concept of the UK's internal market, and its interface with devolution. Particularly significant aspects identified have been the limited nature of the concept of internal market currently deployed by UK Gov, the space for differentiation within this market, and the importance of the principle of subsidiarity. Further work is underway in this area, in collaboration with academics from other Universities, and government officials. This work is expected to have UK-wide consequences. Other significant strands of work opened up include questioning the dominance of a binary devolved/reserved model, and the prospects for more effective shared governance across policy sectors. This has involved an examination of the internal UK channels for exercising influence, as well as the external, foreign relations (paradiplomatic) channels. New networks and collaborations emerging under the SF, include a collaborative bid to the Legal Education Foundation, partnering with Welsh Council for Voluntary Action for a Welsh Civil Society Forum on Brexit (£97,613, PI Dan Wincott); funding for a cross-border initiative with academic partners in Exeter, Bath and Bristol on businesses in Wales and the South West and their responses to withdrawal (GW4, total £37217). I have also secured a collaborative ESRC DTP PhD studentship, working with the National Assembly for Wales on their engagement with EU law through Brexit (2018-, Hedydd Phylip). |
| Exploitation Route | As foreseen in my Pathways to Impact document, the outputs of the research have been directed to a range of beneficiaries, including a better informed general public, though public events (with audiences including invited local school pupils), publications, and media appearances. Civil society and interest groups have been regular attendees at our Wales Governance Centre Brexit events, and my expertise on devolution has been influential in the work of the Brexit Civil Society Alliance, and the Wales Civil Society Forum on Brexit, better equipping these organisations to engage effectively in legislative and policy processes around Brexit. I have also been invited to work with government officials (at both Welsh, Scottish and UK levels, including Cabinet, Treasury and DexEU) and elected politicians (invited Member of the Welsh First Minister's European Advisory Group; oral and written evidence to Parliamentary committees in Westminster and Cardiff Bay, roundtable with UK Gov Cabinet Minister) making contributions in particular on the constitutional context behind the repatriation of powers, the potential significance of the principle of subsidiarity, and the emerging and contested conception of the UKs internal market and its interface with devolution and the exercise of devolved powers. The contributions may be used by political and policy actors in restating and defending the devolution settlements. |

| Description | The work under the project has connected with policy makers and politicians in two main areas. The first has been informing the domestic legislative processes surrounding withdrawal of the UK from the EU. The key piece of legislation is the Westminster Parliament's EU (Withdrawal) Act 2018, which makes changes to the national legal order to ensure withdrawal from the EU is done with maximum consistency and continuity in the law. The original version of the Bill sought effectively to recentralize those devolved competences returning from Brussels. Research conducted under the project offers a critique of attempts at UK-level interventions which effectively recentralise (or profoundly cut across) devolved competence, or which move the previously shared exercise of competence within the EUs multilevel governance framework back into inadequate UK decision making structures (eg Hunt (2017) Devolution; Hunt and Minto, (2017)). Recommendations made in oral and written evidence, based on the project research, were picked up variously by Parliamentary and Assembly committees, and MPs. My recognized expertise also led me to be invited to brief officials from lead government departments (including Cabinet Office and Department on Exiting the EU) on the approach to devolution in the legislation, and I had raised from the start that the recentralization of powers, and any diminution in the degree of existing devolved influence and policy autonomy revealed in my research would be problematic. The research also informed discussions with Welsh government officials and politicians in respect to the role and form of Welsh continuity legislation, the legislative safeguard sought to respond to the perceived threat to devolved competence by the original version of the Withdrawal Bill. Beyond the political institutions, the research formed a basis for engagement with third sector and public interest organisations, (including the Brexit Civil Society Alliance (formerly the Repeal Bill Alliance)) to advise on the approach they take to the devolution aspects of the legislation, and which amendments to promote. I also directly influenced the drafting of a new clause on maintaining current levels of health and environmental protections, proposing it to be recast in light of concerns about its implications of devolved legislatures. This was taken on board in the final amendment which was tabled by Lord Warner on 1 February 2018, and though it received cross-party support, it did not make it into the final version of the Act. Overall, and following significant and well-marshalled political opposition to the proposals, the final version of the legislation as adopted is less intrusive for devolved competence. The second strand of work is on shaping the emerging debate on the UK internal market, and its consequences for devolution. In early 2017, the Prime Minister introduced the idea of a 'UK internal market' as requiring common UK wide rules and some degree of recentralization of powers from the devolveds, to do the work formerly done by the EU internal market rules. The initial reports under the project identified points of variation in the exercise of devolved competence at the intersection with EU law, and this is the basis for the challenges I have made to assumptions about the extent to which uniform UK wide regulation may be required for the operation of the UK internal market. I began developing this idea in published form in Hunt (2017), but had trailed it in a presentation to an Interparliamentary meeting of the Chairs of the EU Committees (December 2016). Subsequently, flexibility in the UK internal market was discussed in sessions with Scottish government officials (Liverpool, 2017, organized by Prof Michael Dougan) and with Welsh Government officials (2017). Flexible alternatives to hard regulation, and space for policy divergence in the UK internal market were subsequently recognized in a political agreement reached in October 2017 between the UK, Scottish and Welsh governments. Work on the internal market concept and its legal significance continues. An event was convened on the UK internal market in Cardiff (June 2018) which brought together officials from Her Majesty's Government, Welsh and Scottish Governments, along with key academics from Cardiff and other institutions to begin to scope out the concept and its implications for devolution. This event led to further, separate engagements with (at their invitation) HMG officals, as well as Scottish and Welsh officials, over 2018 and 2019. As of March 2020, further engagement is in the pipeline, useful collaborative relationships have been established, and publications are anticipated. |

We then went to the two official campaigns to get them to make their case. These videos are at the heart of our Better Referendum meetups - those that didn't have the time to find a meetup or organise one, could watch the videos here'. I contributed to two of these videos as an expert commentator (social policy and regions and nations). These vidos were shown as packages in meetings across the UK and could also be accessed directly on the ERS site. ERS reported over 12000 views, plus 500 at events, with reports of users being better informed about their decision. |

The discussions over the day considered the repatriation of competences - which powers are to be returned from Brussels and to which level, and the consequences for the current devolution settlements. Prospects for devolved Continuation Acts were discussed (and their limited legal effect acknowledged), and the critical future significance of the UKs internal market was stressed. A report is forthcoming. |

More directly, the repatriation of regulatory powers to the UK also entails an enhanced role for the devolved governments in the elaboration of domestic regulatory policies. However, the risk that regulatory divergence within the UK might create friction in internal trade in goods and services has prompted the UK Government to propose enshrining a Market Access Commitment in UK law. | Results and Impact | In cooperation with the Welsh Centre for International Affairs, we held a public debate pre- Referendum (8 June 2016), comprising 3 panels, focusing on the impact of EU membership on: Jobs and Economy, Society and Law, and The UK and International Relations. Across the panels will be a mix of politicians, businesspeople, academics and others with a balance between 'in', 'out' and 'neutral' voices. Each discussion included a Q&A, providing an opportunity for the audience to ask questions to the speakers. Speakers included: Lord Dafydd Wigley (Plaid Cymru), Berwyn Davies (Business consultant), Nathan Gill (UKIP), Dr Joanne Hunt (Cardiff University School of Law and Politics and 'The UK in a Changing Europe'), Baroness Julie Smith (Liberal Democrats), Dr Rachel Minto (Cardiff University School of Law and Politics and 'The UK in a Changing Europe'). The audience included the general public, with a wide range of views, and there was questioning and lively discussion.
