Brexit and Northern Ireland: The Constitutional, Conflict Transformation, Human Rights and Equality Consequences

Abstract
RESEARCH CONTEXT
N. Ireland is the region of the UK most at risk from Brexit. Like Scotland, a majority voted to remain in the EU. This project is a collaboration between the Law Schools in Queen's University Belfast and Ulster University and the region's principal human rights organisation, the Committee on the Administration of Justice. It is designed to disentangle the legal elements of Brexit with regard to N. Ireland and to communicate the related policy and practice implications in user-friendly formats. The audiences to be addressed include parliamentarians and policymakers in NI, Britain, EU and the ROI, as well as wider civil society. We will focus on two broad and closely inter-connected areas (i) issues related to the constitutional position of N. Ireland and the process of conflict transformation and (ii) questions related to the protection of human rights and equality. One practical lesson gleaned from previous work is that policy development risks irrelevance if prepared in a vacuum that does not take account of legislative realities. To address that need, Greenberg (parliamentary draftsperson consultant) will provide practical legislative advice on all outputs, including discussions on identifying delivery opportunities and obstacles and where necessary, specific legislative provisions.
The EU has provided practical, financial and political support as well as essential legal protections for post-conflict N. Ireland. The constitutional arrangements in the Good Friday Agreement assumed common EU membership. Brexit risks arousing tensions around the land border and citizenship that have been moderated by EU membership. More generally, many view departure from the EU as having energised a culture of intolerance and disrespect, seen in the language of 'taking back control' (focused on immigration), and calls to repeal the Human Rights Act. The collapse of the N. Ireland Assembly in Jan 2017 renders the need for user-friendly non-partisan legal and policy advice on complex matters related to N. Ireland and Brexit all the more compelling.
AIM & OBJECTIVES
The aim is to provide clear legally informed policy advice with regard to six key challenges.
The objectives are:
1. To analyse the impact of Brexit on (a) the constitutional position of N. Ireland and the process of conflict transformation and (b) human rights and equality.
2. To review the legal, academic and policy literature.

Planned Impact
1. This is an initiative designed by academics from the Law Schools at both universities and the leading independent human rights organisation in N. Ireland (QUB-UU-CAJ). The project will assess systematically the impact of Brexit and provide clarification regarding its precise consequences.
2. The project will produce a series of six bespoke policy reports (20 page max, with three page executive brief), detailing the legal, political and legislative implications of Brexit for N. Ireland: Brexit and the peace process; Brexit and North-south relations; Brexit, border controls and free movement in and between N. Ireland, the Republic and Britain; Brexit, xenophobia and racism; Brexit and socio-economic rights (especially employment rights); Brexit and wider human rights and equality issues (including LGBTQ rights, anti-sectarianism, gender equality, children's rights).
3. A parliamentary draftsperson Daniel Greenberg will provide practical legislative advice on all policy-related work. In practice, this means that the proposed six policy outputs will include discussions on identifying delivery opportunities and obstacles and, where necessary, specific legislative provisions.
4. 20-30 bilateral meetings will be held with a wide range of stakeholders across civic society in N. Ireland.
5. A series of six town hall meetings will be held in N. Ireland targeted at local civil and political society.
6. The team will complete at least a dozen TV and radio interviews, four op ed pieces in leading print outlets and six online blogs over the course of the project.
7. The team will develop and implement an online and social media strategy including a project website and bespoke twitter account. QUB have agreed to host and maintain this for at least five years following the close of the project.
8. To team will disseminate the project findings at a major project conference in Belfast - as well as further satellite events in Dublin, London and Brussels.
9. The primary beneficiaries of this project will be the UK and Irish Governments; political parties in N. Ireland and the Republic (the project is supported by the Irish Government - see attachment letter); as well as civil servants and policy stakeholders in the EU, UK, N. Ireland and the Republic. The secondary beneficiaries will be civil society, human rights and equality groups and the trade union movement and employers and the business sector (e.g. regarding free movement of workers, employment law).
10. The project team has well-established and productive working relations with relevant officials in London, Dublin and Belfast, with individual Ministers and with political parties and individual politicians. Work produced by team members is widely regarded as authoritative and is respected. The project team is therefore well placed to advance this research and to achieve the stated impacts.
11. This is a collaborative project designed to maximise reach into N. Ireland civil society. CAJ is the leading independent human rights NGO in Northern Ireland which has won several major human rights prizes including the Council of Europe Human Rights Prize. CAJ co-convenes (with Unison) the Equality Coalition of 80 human rights and equality organisations.
12. Harvey, McEvoy, O'Connell, Gormally and Holder have extensive experience of public engagement and media work. Members of CAJ staff will be seconded to the research team both to contribute to the legal analysis and to assist in the engagement, advocacy and knowledge dissemination work. All of the impact case studies submitted by QUB and UU Law were graded 4* in REF 2014 (including those involving members of the current team).
13. The project team will work closely with Prof. Menon and colleagues to ensure maximum coordination with other projects funded by the current initiative.

ARTICLE 50 ONE YEAR ON: BREXIT AND IRELAND/NORTHERN IRELAND
| Description | 1. BrexitLawNI responded well to the challenges of conducting a research project in the midst of an ongoing process wrapped within a broader constitutional crisis for the UK (and these islands). The project outcomes and the practical impact of our work exceeded our original expectations. The team produced accessible material throughout this project to inform the public, practitioners, as well as policymakers on the potential constitutional, conflict transformation, human rights and equality impacts of Brexit for Northern Ireland. The project team has developed an approach to public engagement that has facilitated the sharing of accessible materials on complex legal, constitutional and political questions to a non-specialist audience - this has included the extensive use of new media to inform the public debate. 2. The main outputs of this project took the form of six policy reports, each examining a different theme: the peace process; North-South relations; border controls and free movement; xenophobia and racism; socio-economic rights; and wider human rights and equality issues. These reports are all openly accessible via our website. However, we also delivered a significant range of other outputs with a particular focus on making these as accessible as possible to a non-specialist audience. The format of using blogs proved to be of particular value via the UK in a Changing Europe, QUB Policy Engagement, our own website (BrexitLawNI) and other outlets. 3. Our project reports include accessible summaries and further information about our main findings are available there. However, to summarise, first, we found evidence to support the view that Brexit creates a tangible risk to the peace process and further undermines the sort of future envisaged for Northern Ireland in the Good Friday Agreement - including the vital elements around North-South cooperation. This was apparent in our interviews, our stakeholder meetings and in the town hall events that we held. Second, our research supports the view that Brexit risks undermining significant human rights and equality guarantees. There was a danger that this aspect of Brexit would be neglected - our project was one part of the effort to ensure that this did not happen. Third, we unearthed a neglected aspect of this discussion: the risk that Northern Ireland would become 'one big border' after Brexit. Our research found evidence to suggest a real risk of increasing racism, xenophobia and racial profiling as a direct consequence of Brexit. This dimension of the conversation has been neglected and our project outcomes have, to some extent, helped to address this. 4. The advantage of a project such as this was that we were able to feed the findings into the ongoing process and thus, along with others, help to inform some of the outcomes. There is evidence to suggest that this has been the case. 5. As part of this project we developed our own project website, twitter account, and facebook presence. One of the key lessons here is the significance of giving coherence to a project by using a project title 'BrexitLawNI' and making effective use of social media. This played a significant role in ensuring we were able to engage effectively in the public conversation about sharing our research findings. We have made all our project findings, reports and interventions available via our social media platforms and as indicated we have placed a particular emphasis on making these as understandable to as wide an audience as possible. |
| Exploitation Route | Our findings will be of assistance to government, democratic institutions, policy makers and civil society across these islands when reflecting on the future of relationships in the context of Brexit. We placed particular significance on communications and engagement in our work and as a result the project has had a strong presence across the media locally and globally. The stakeholder engagement that we conducted also means that 'BrexitLawNI' has strong recognition as a concept in the debates. Our six project reports will retain their value as a contribution to discussions of the future relationship and on how the next steps in the Brexit process are managed. As with the vast bulk of our outputs we have written everything in terms that are intended to be as accessible to a non-specialist audience as is possible. Professor Colin Harvey has, for example, already held a number of seminars at the Foreign and Commonwealth Office in London to groups of civil servants working on Brexit and the intention would be that our research outcomes will continue to be of value and use to civil servants and policy makers in London, Brussels, Belfast and Dublin when working through all the implications of Brexit for this region. The collaboration with local NGO - the Committee on the Administration of Justice - has been of particular value in ensuring that we have had sustained and effective civil society engagement, most evident in our stakeholder meetings but also plain at events such as our conference on Post-Brexit Citizenship Status at QUB on 4 March 2019. The fact that this was an oversubscribed event attended by the main political parties, key policy makers and civil society actors is clear evidence of our ability to inform the current debate and shape the future discussions. The hope and intention is that our work will be taken forward and shape the next steps in the Brexit process. |

BrexitLawNI team members shared some of our research findings, and approximately an hour was devoted to discussion with attendees about their Brexit-related concerns. This was a very successful meeting as a lot of information was shared by attendees. We also had requests for further information about our project and scheduled an interview with one of the attendees. |

| Results and Impact | BrexitLawNI, in partnership with StepNI, the Stronger Together Network, the Equality Coalition, the QUB Human Rights Centre, and UNISON held a townhall event in Dungannon targeted at the migrant community in NI. The purpose was to disseminate information about Brexit that might be relevant to the migrant worker and black and minority ethnic community, as well as gather information from this community on their concerns about Brexit and how Brexit is impacting them. Approximately 80 people attended this event from a wide variety of backgrounds.
