Health Governance after Brexit: Law, Language and Legitimacy

Abstract

Language such as 'a red, white and blue Brexit' or 'Brexit means Brexit' allows for an array of ideas about Brexit to be projected onto the process of the UK leaving the EU and what it means. The EU is not just a political organisation, it is also a legal organisation. Leaving the EU means agreeing a new legally expressed relationship for now and for the future. It also means new UK laws, such as a Trade Act and Immigration Act.

We are investigating the (legal) language of Brexit, and comparing how elites and ordinary people understand it. We are doing that in the context of a topic that matters a great deal to the general public: health and the NHS. We want to analyse what the new laws will mean for patients, for NHS staff, for drugs, medical devices and equipment, blood and organ donation, and for laws that affect our health, like food safety and tobacco regulation. It may not be immediately obvious what the effects of general laws (like the Trade Act) or agreements (like a UK-US trade agreement) will be on health and the NHS. We will analyse the texts to find out.

To make that legal analysis useful, we will work with some specific groups, all of whom have expertise in key areas impacted by Brexit, to help us understand what scenarios the people they work with or represent are facing. These groups will include Kidney Care UK; the Faculty of Public Health; and the Colleges of Midwives in the UK and the Republic of Ireland.

Once we have done that, we will find out how the general public understand what is happening to health and the NHS post-Brexit. Are people happy with the changes? Who do they think is responsible and should be responsible? Do they think the new law is legitimate? We will work in two places that represent different issues in a post-Brexit world: the north of England, and Northern Ireland. The north of England is a 'left-behind' region economically, and this is one explanation given for its pattern of Leave voting. Northern Ireland faces special challenges post-Brexit, because it shares a land border with the rest of the EU. Health services have been shared in the north of the island of Ireland for a long time, and EU law has helped to support that.

We will carry out street interviews, to understand how ordinary people think about abstract ideas like Brexit and accountability. We will use the information from our legal analysis to ask people what they think about what the new laws mean - for patients, for NHS staff, and so on.

Finally, we will compare the language that the law uses, and that experts use, with the everyday language used by the general public. When we talk about abstract things, we often use metaphors, like 'red, white and blue Brexit'. Examining metaphors will help us to understand how people feel, and whether the general public feel the same as experts. Metaphors will help us find out if there are gaps between how people feel about the new post-Brexit laws on health and the NHS, and what those laws achieve. This will help us understand whether post-Brexit law enjoys social legitimacy - and if not, why not. That could - and should - inform policies about what to do about it.

Planned Impact

The project builds upon the applicants' work. Our professional and policy networks (within and beyond academia, law and public health) will help cement its impacts. We will ensure the insights developed become widely read, and central to academic, policy and public debates on post-Brexit governance. We will also ensure the project findings are impactful within debates on the public understanding of constitutional arrangements and their social legitimation.
The desk-based and street interview research comprising the core of this project will inform debates within academia, regulatory and policy stakeholders, and wider publics, on elite and public understandings of post-Brexit health governance and its legitimacy. This will in turn make it possible to further reflect on improving legitimacy should a gap between elite and public understandings be revealed. The research is likely to be of specific relevance to (1) policy/legislative communities; (2) health professionals; (3) third sector organisations; (4) wider publics; and (5) scholars (see Table 4 in separate document and Pathways to Impact).

We have in place a strategy to ensure the integration of perspectives from elite stakeholders from the very start of the project, throughout and long after. Co-producing scenarios at the initial stages with selected co-producer stakeholders ensures direct policy and practical relevance for those stakeholders, and others in similar positions. We therefore expect the legal analysis we undertake to have at least an indirect and possibly a direct impact on policy and practice of those stakeholders. Our dissemination plans ensure that our analyses reach other elite stakeholders with an interest in the work in a timely manner.

Wider publics feed into the project through street interviews, and an important aspect of the project's findings will be communicated through the documentary film, which will be launched in a public event in Belfast. Wood has already worked with ShoutOut UK and will continue to do so after the project ends to ensure sustained legacy for the project's findings. This will ensure the alignment of the project with their needs.
The project Steering Group (see Case for Support) lends significant expertise and support for facilitating project impact. The Steering Group includes law and governance scholars (Donnelly, Hunt; Schillemans); sociologists and social research methods scholars (Benson; Fierlbeck; Richardson); and public health and science specialists (McKee; Galsworthy) (see further Table 7).

Our plan to integrate the responsiveness of the research process and impact-generation within the design of the research entails the involvement of elite stakeholders in co-constructing scenarios affected by Brexit. This follows from Wood's current ESRC project focused on co-production of research questions and data collection with regulatory bodies (ES/L010925/1). Co-production will ensure the research is embedded in key user communities. Wider public dissemination of findings will also occur through media pieces, tweets with a dedicated #, and project website. Tweets will facilitate public participation through project team responses. Contacts made during the project will be developed and maintained, and informed of events and outputs, so as to continually secure and gauge impact.

The co-production process will be innovative in extending beyond project design, incorporating data collection and project outputs. The street interviews will involve members of the public with the documentary film to integrate elements of the data collection with public-facing engagement outputs. The project will not only co-produce key questions and themes informing the research, but data collection and engagement/outputs will be integrated at the end of the project in a reflexive way. This will ensure significant legacy engagement and a broad potential impact from the project.

All of these workshops were based in London, despite efforts to persuade schools or colleges elsewhere to take up the offer. We repurposed some of our dissemination funding to support these workshops, with the support of the ESRC. Feedback from the workshops was positive: 'very informative. Covered the issues needed for us to enter into the next stage of Brexit' (Senior Youth Worker/Pastoral Tutor, South Thames College). Description We found - through co-working with experts in the health policy field and providing technical legal analysis - a lot of detail about how the UK needs to arrange law and policy so that the worst aspects of Brexit for health and the NHS can be mitigated. This opens up further research questions about the legitimacy of post-Brexit health governance as the post-Brexit governance landscape emerges.

We found - through talking with people in communities in Northern Ireland and the north of England - that people care about the NHS, are fearful for its future, and feel disempowered in terms of holding government to account for the future of the NHS.

We achieved - through a successful carrying out of our fieldwork comprising over 400 street conversations - a development of a method ('hit and run ethnography') for gathering rich ethnographic data on people's perceptions, fears and anticipations on health and Brexit.

We achieved - new connections and collaborations with the local communities we visited; with local councils and representatives; local community leaders and the general public.

Description Through our engagement and co-production with selected key actors in the health policy sector, we have provided detailed legal analysis which informed their policy positions, and their engagement with government and the public. Obviously, the serious economic consequences of Brexit cannot be avoided by research projects like this one, but through educating and informing an important policy sector, with implications for health, wellbeing and life itself for UK residents, in a small way, we have contributed to mitigating the worst aspects of (certain types of) Brexit. Our legal and policy analysis helped the health sector to understand how very harmful No Deal Brexit (in the sense of leaving the EU without a Withdrawal Agreement) would have been. We have highlighted the special nature of health care on the island of Ireland, and fed into discussions of how that geopolitical space should legitimately be managed now that the UK is outside the EU. In addition to the impact of our work within the UK, we have engaged some health policy actors in the rest of the EU, to help them understand the external implications of Brexit for health.

Title Strategically Targeted Ethnographic Conversations 
Description As there is no 'other' category in the dropdown menu, I have picked one which clearly isn't accurate. Our research aims to reveal what 'left behind' communities want from Brexit that accounts for the highly contingent and volatile context of the 'Brexit process', and adequately captures diffuse interpretations of Brexit among members of a socio-economic group that are less likely to participate in political research. Our approach combines two different methodological logics: ethnographic and quasi-experimental. On the one hand, we adopt an ethnographic approach with the aim to "give voice to narratives that are often unpalatable, excluded, demonized or poorly understood" (McKenzie, 2017a, p.202). This approach seeks intensive immersion in the communities we study, with an 'ethnographic sensibility' that the everyday conversations we have with individuals in these communities will lead to valuable insights into their interpretations of political processes. We therefore seek to embed ourselves as immersively as possible within left behind communities, given our resource constraints, to get a sense of how they interpret Brexit and what they 'want' from it. We do not pre-determine what this might be, and seek to be as accommodating as possible to those who are genuinely marginalised and unlikely to engage with political research to articulate what they want. As detailed below, our fieldwork was carefully tailored to engage members of left behind communities who would not usually engage with standard social scientific research. Such informal 'street conversations' draw from a method developed by Richardson et al (REF) for recruiting focus group participants their study of co-production of public services with disadvantaged communities in Manchester. Our approach can also be classed as ethnographic to the extent that we sought to extensively document our reflections on our own positionality in relation to our data (see Appendix). Second, the specific approach we adopt to fieldwork incorporates a 'quasi-experimental' logic in which we sought 'targeted' engagement with members of the communities to elicit their expectations and hopes on the emotionally charged topic of Brexit. In our fieldwork, we sought to plan and structure our conversations as 'interventions in the field' and to some extent 'control' the responses we were likely to receive by adopting a form of visual photo elicitation (Harper, 2002). To quote from experimental political science, we sought to 'make things happen' (Jilke et al, 2016, p.69) by eliciting responses to a cue that would generate relevant data, while accounting for the likelihood that the conversations were likely to be contentious, because of the Brexit topic. This was, firstly, an important logic to adopt because of the volatility of the broader political climate around Brexit. Our research was highly sensitive to temporal instability, for example in the rejection of Theresa May's withdrawl agreement by Parliament, and the subsequent delays to Brexit that came about. Our research question of what people in 'left behind' communities see as legitimate post-Brexit governance was subject to significant temporal shifts, so an 'interventionist' logic helped us to strategically approach the 'field' during times when members of the public were likely to be engaging with the topic, and thus more likely to have relevant knowledge about ongoing political events. Visual photo elicitation, a 'soft' experimental method often used in qualitative studies of ongoing traumatic events (Clark-Ibanez, 2004; Lorenz, 2011), is useful for this purpose. This is because of the 'subtle function of graphic imagery', specifically 'its compelling effect upon the informant, its ability to prod latent memory, to stimulate and release emotional statements' (Collier, 1957, p.858, quoted in Harper, 2002). Compared to other methods that seek to minimise the emotional pull of a topic, for example in focus group or semi-structured interviews, photo elicitation seeks to bring emotive topics to the surface in everyday engagement, prompting the participant to clarify what sometimes imperceptible feeling 'mean' to them. Photo elicitation is often used for personal or autobiographical research (often using photos taken by the participants), but can also be used for broader contentious issues that participants may be uncomfortable speaking about, using photos with common popular connotations. By showing the participant a relevant image to the contentious issue, these 'connect an individual to experiences or eras even if the images do not reflect the research subject's actual lives' (Harper, 2002, p.13). Hence, we hope the 'reactions' provoked by photo elicitation will reveal the kind of emotive desires and expectations that qualitative methods, usually requiring considered reflection from the participant, find more difficult to access. Photo elicitation does not privilege generalisability, but rather seeks to maximise the 'authenticity and confirmability' of data on emotive topics by directing participants towards engaging their emotional understanding, via the image they are shown (italics added). We believe this methodological approach is a useful way of addressing limitations of existing data on public 'demands' for post-Brexit governance. The following subsections detail the choice of methods in extended detail, implementing the need in ethnographic research for 'careful documentation of each stage of the research and analysis process will enable the research users and readers to make informed decisions regarding its relevance to other contexts'

Results and Impact This was an outreach event for the project that took place in the Gleadless Valley estate in Sheffield. It was organised by Dr Matthew Wood and a team of undergraduate students under his leadership, who spent weeks prior to the event engaging with local residents and encouraging the to attend. Academics from Sheffield Halam University also took part. Academics, students and the general public got together in the Gleadless Methodist Church and the John O'Gaunt pub, where they took part in an innovative debate on the topic of Brexit. All participants were asked about what Brexit meant to them and what politicians need to hear in relation to Brexit. The event sparked a lot of debate, sharing and exchanging of views and opinions, and it was informative for all participants about the impact of Brexit on communities and the divisions Brexit is creating.

Results and Impact We used ShoutOutUK's online platform to showcase the 'Brexit, Health & Me' film along with two sets of learning materials (A-level quizzes) that we wrote. These reached at least 111 students/young people aged 16-19, accessing via the ShoutOutUK portal (75 young people), or by 3 virtual workshops involving online screenings (36 young people) run by ShoutOutUK. All of these workshops were based in London, despite efforts to persuade schools or colleges elsewhere to take up the offer. Feedback from the workshops was positive: 'very informative. Covered the issues needed for us to enter into the next stage of Brexit' (Senior Youth Worker/Pastoral Tutor, South Thames College). The film 'Brexit Health & Me' is now available on Amazon.
