Abstract

The legal debate of Argentina's debt is polarised and focuses either on the creditors' formalistic legal perspective that the contractual obligations need to be fulfilled and debts repaid; or a moralistic / political objections to debt repayments which are often expressed in legal terms but not grounded on a thorough legal argumentation. My research will provide an academic legal analysis of some of the issues raised by the opponents to debt repayment in order to assess whether the legal validity of the creditors' claims can successfully be challenged from the perspective of Argentinean domestic law, and /or from the point of view of international law.
