Toward the development of post Covid-19 gender policy measures to end modern slavery and exploitation in the Bangladeshi garment sector

Abstract

This project aims to investigate the impact of the COVID-19 pandemic on women in garment sector in Bangladesh that supplies goods to retailers in the Global North and recommend gender policy measures to end modern slavery and exploitation with the sector. Our proposed research responds to ongoing global concerns over working conditions in a developing nation. Amid the COVID-9 Pandemic, international news coverage and NGOs' reports have highlighted that big retailers, some based in the UK have cancelled orders without even paying for production costs already laid out, delaying payments and asking for discounts from factories. As of April, 2020, more than US$3 billion in orders to around 1200 factories were in limbo, leaving around 2.8 million workers, mostly women, facing poverty and hunger. To meet orders that were still on the books in April and May, factory owners forced workers to continue to work, leaving them at risk of catching COVID-19 and spreading the virus to their families and communities. Therefore, amid the pandemic, workers have either been laid off without pay or forced to work in unsafe environments. Given that, neither the Government, factory owners nor retailers are taking any clear responsibility for workers who have been laid off without pay, meaning they no longer have the means to provide for families.

Prior social science research has highlighted prevalence of exploitation, unequal pay, gender discrimination, harassment, forced labour (including excessive overtime), physical and verbal abuse and so on associated with the women workers in the garment sector. Many people in the North recognize these as modern slavery. A few studies suggested that the prohibition of slavery (such as harassment; force labor) can play a significant role to improve the working condition for female workers in the garments sector. Given this, the current Covid 19 pandemic takes a new shape in slavery as women workers are now most vulnerable because of the absence of social safety net. There is also huge concern over slavery by women workers as no one (government inspector, compliance auditor, owners, buyers and even workers rights NGOs) is clearly monitoring whether factory owners are complying with existing policy, and transparency and accountability mechanism during the period of pandemic. Given the circumstances, we conduct situational analysis of women workers both during and post COVID 19 pandemic times and seek to develop gender policy measures for eliminating slavery and creating a sound/sustainable social safety net within the global clothing supply chains operating in Bangladesh. For this research, we use mixed research methods, i.e. survey workers and compliance auditors and interview key stakeholders and gender policy informants within the garment sector in Bangladesh.
 
Description Our research collaborated with trade justice charity Traidcraft Exchange UK, commissioned by the Modern Slavery PEC with the funding of AHRC completed on Dec 15, 2021, explored conditions of women workers working in UK fashion retailers' supply factories based in Bangladesh during the Covid-19 pandemic. Our full research report (on this link https://modernslaverypec.org/resources/bangladesh-garment) released on 26th of January 2022 provides specific recommendations for the UK Government, Bangladesh government and stakeholders to eliminate exploitation of women from the global clothing supply chains. The in-depth qualitative research saw face to face interviews carried out with female and male garment workers, factory managers, industry leaders and trade unions over the course of eight months between November 2020 and July 2021, as well as discussions with a number of development agencies and international advocacy NGOs.
Our research shows that the immediate impact of Covid-19 and some of the actions taken by the UK fashion retailers - such as cancelling orders, refusal to pay for work in progress and demands for discounted prices - disproportionately impacted the vulnerability of women workers by contributing to an increase in gender violence, abuse and economic hardship. We found the pandemic exacerbated interrelated vulnerabilities in economic, job, food and housing security, as well as health and wellbeing, with women workers struggling to support themselves and their families.
The research found an increase in intimidation and threats, physical and sexual violence, and restriction of movement. During pandemic time, workers could not afford to be sacked. These devasting impacts were heightened and, in some cases, directly caused by retailers and brands selling into the UK and other markets in the Global North.
Our findings challenge some of the conventional Corporate Social Responsibility (CSR) practices by UK retailers such as ethical codes of conduct, social disclosure and social audit practices for improving working conditions in their clothing supply chains, as these have failed to protect female workers' vulnerability, particularly during the Covid-19 pandemic.
This research is important as it addresses challenges raised by Covid-19 such as investigating the impact of the pandemic on women workers vulnerable to forced labour in the garment sector in Bangladesh. Based on our findings we recommend that The Bangladesh Government should consider reviewing and revising its legal framework for protecting the rights of all workers, particularly women, in its garment sector. Most importantly, the Bangladesh Government should also consider the feasibility of an independent watchdog to ensure that owners respect women's rights at the factory.
Our research recommends to the UK Government to consider introducing a fair purchasing regulator, a Fashion Watchdog, which could investigate and fine brands and retailers if they were found to breach a statutory fair purchasing code in their dealings with garment manufacturers, particularly located in global South.
This research is novel from an interdisciplinary research perspective, because business researchers, social science researchers and civil society organisations have met to address one of the most critical global issues during Covid-19 pandemic time. Both academic collaborators and our civil society partner Traidcraft Exchange UK came together to produce impactful insights that have the potential to drive UK policy changes.

PI Contribution In this partnership, we have provided original research findings that Traidcraft Exchange is using for its campaign for policy change. Traidcraft Exchange is using our research that recommends to the UK Government to consider introducing a fair purchasing regulator, a Fashion Watchdog, which could investigate and fine brands and retailers if they were found to breach a statutory fair purchasing code in their dealings with garment manufacturers, particularly located in global South.
Collaborator Contribution Traidcraft exchange, as a non-academic partner has become instrumental in designing our research questions to methodological improvement. This partnership has enriched our interdisciplinary research perspective and culture. In this project, business researchers, social science researchers and civil society organisations have met to address one of the most critical global issues during Covid-19 pandemic time. Both academic collaborators and our civil society partner Traidcraft Exchange UK came together to produce impactful insights that have the potential to drive UK policy changes.

The UK EITI has now offered me a full member of the civil society constituency. While my present research projects influenced EITI to honour me as a civil society representative, I will have a room to contribute to the development of EITI standards by including social and human rights issues (which were directly aligned with my research).

Results and Impact In Dec 2022, GRI, a global authoritative body for sustainability reporting standards, after interviews, appointed me an advisory member. Sitting as an advisor is quite interesting and directly related to my current research on workers' rights and modern slavery. This will give me a strategic opportunity to use my research findings as GRI, via its Global Sustainability Standards Board (GSSB) brings some new labour rights issues (including women's rights in the garment sector etc, our research can reflect.

Results and Impact Our research findings inspired Liz Twist MP and and Peter Aldous, MP to jointly host a drop in session in Westminster so that we can share our research findings to UK MPs before they put something as bill to the parliament. We shared with UK MPs our findings how UK retailers' unfair practices impacted vulnerability of garment workers in Bangladesh. At UK Parliamentary drop-in event in London, researchers from the University of Aberdeen (Shamima Haque, M. Azizul Islam), Royal Holloway, University of London (Lauren McCarthy, Katherine Brickell), University of Nottingham (Sabina Lawreniuk) and Traidcraft Exchange (Fiona Gooch) have provided evidence on how UK fashion retailers' unfair practices impacted the livelihoods of garments workers in Bangladesh and Cambodia during Pandemic time. Although Cambodia's context was presented by other researchers, most of the MPs who attended showed more interest on Bangladesh findings than Cambodia.
