Abstract
The question of the UK's relationship to the European Union (EU) is a live one as the Conservative Party propose renegotiation and an in-out referendum in 2017, setting the agenda for the other parties. The EU itself is under stress. There is a rise in Euroscepticism in many parts of Europe, while at the same time there are pressures for closer integration to deal with the crisis of the Euro. Following the Scottish independence referendum, the UK constitution remains unresolved, with proposals for further devolution to Scotland, Wales and Northern Ireland and more diffuse pressures to address the government of England.
The constitutional tensions within the European Union and within the UK are linked. There is evidence that attitudes towards renegotiating EU membership and to withdrawal may be different across the nations of the UK. There may be different interests in European policies and priorities on issues such as energy, migration, agriculture, competition policy and regional policy. Demands for reform of the devolution settlement include better mechanisms for representing the devolved territories in European policy-making and in the process of renegotiation and EU treaty reform.
Another issue is the Conservative proposal to replace the Human Rights Act, which entrenches the European Charter for the Protection of Human Rights and Fundamental Freedoms (EHCR) in UK law. ECHR works differently in the devolved territories from England, as in the former it is also entrenched in the devolution settlements.
The project will analyse these issues in a form accessible to stakeholders and the public. It will explore options for change within the UK and Europe, drawing on comparative experience. It will engage stakeholders and the general public in the debate on the UK and Europe. Dissemination will be through regular briefings, posted on the programme web site and that of the Scottish Centre on Constitutional Change; seminars around the UK for the general public and for stakeholders; and an active presence in print, broadcast and social media. There will be an engagement with governments across the United Kingdom on the basis of strict impartiality.

Planned Impact
There are four targets for impact
1. Civil society, including business, trades unions, the voluntary sector and professional bodies. They are interested in the impact of the European issue on their sectors and how they might influence the process.
2. Civil servants in London, the English regions, Scotland, Wales and Northern Ireland parliamentary officials at Westminster and the devolved legislatures. They are interested in the options, in comparative experience and in how different arrangements might work in practice. They are also interested in exchanging experiences among themselves on the impact of Europe and the main issues. Our experience during the Scottish referendum showed that they are also keen on testing their own ideas out with academic specialists.
3. Parliamentarians. The UK Parliament and the devolved legislatures will have committees to which written and oral evidence will be presented. Local governments in England will also have an interest.
4. The general public. The project will aim to inform the electorate about the issues and options, in an impartial manner.
The mechanisms for impact will be:

Description | This was an impact rather than a research grant. The main findings are: The European Union is a key factor underpinning the UK devolution settlement. Key competences are Europeanized and devolved at the same time. EU membership allows a more extensive internal devolution than would otherwise be possible. The EU provides a discursive space for new ideas about shared sovereignty and open borders, which also underpin the devolution settlements, especially in Northern Ireland. There is dispute about the way competences will be brought back to the UK. The Withdrawal Bill proposes to take all EU competences back to Westminster. This is not accepted by the Scottish and Welsh Government. The Supreme Court has made it clear that this refusal of legislative consent will not affect the power of Westminster to legislate for Brexit. The Withdrawal Bill leaves open a number of key issues, including the long-term future of retained EU law, and the whole question of the meaning and implications of the 'UK Single Market' after Brexit. The experience of the Withdrawal Act and the dispute about the repatriation of competences has exposed existing gaps in the devolution settlement Brexitt destabilises the UK constitutional settlement. |

I have founded an international network, the Islands and Unions Network, to encourage exchange of ideas and findings in this field. |

Description | The grant was aimed at increasing understanding of the EU question during the negotiation of the UK's position in the EU, the 2016 referendum and its aftermath. The contribution was to clarifying the issues, informing government and civil society, and helping the public to understand the issues.We have contributed to parliamentary committees, discussions with civil servants and seminars with civil society groups. I was engaged as an adviser to the Scottish Parliament European Affairs Committee for its inquiry into Brexit and provided briefings, which were used during evidence sessions and in the report. In accordance with the rules, none of this was directly attributed to me. I have given and written evidence to House of Commons Scottish Affairs Select Committee (twice); Public Administration and Constitutional Affairs Committee (twice) ; House of Commons Select Committee on Exiting the European Union; Scottish Parliament Constitutional Affairs and Finance Committee (three times); National Assembly for Wales External Affairs and Additional Legislation Committee and Constitutional and Legislative Affairs Committee; House of Lords Constitutional Affairs Committee (twice) and European Parliament Constitutional Affairs Committee. This is recorded in the reports of those committees. I prepared a report for the European Parliament on the impact of Brexit on Scotland, Wales and Gibraltar and a paper on Alternatives to EU Membership, Scottish Parliament European and External Affairs Committee. I have had a series of off-the-record discussions with officials of the Scottish Government on Brexit and devolution. By definition there is no record of the impact of these. With my colleagues in the Centre on Constitutional Change (CCC) I have frequent meetings with officials of the UK Government including from the Treasury, DExEU, Scotland Office, Cabinet Office, Foreign and Commonwealth Office and Prime Minister's Policy Unit . All of these meetings have been initiated by the departments themselves, indicating that they find them useful. My findings have regularly been used in the Scottish, UK and international media. Sometimes, this is by them using the blog. At other times, I have done interviews. Since this grant started, I have given 230 media interviews on the topic, in English, French, Spanish and Italian. This has ensured wide UK and international dissemination of the work. I have given 69 lectures on the topic to academic and civil society audiences, in Scotland, England, Wales, Ireland, Spain, France, Belgium, Norway and Italy. I organised 18 public meetings with this grant, in Edinburgh, Brussels. Newcastle, Sheffield, London, Aberdeen, Inverness, Glasgow, Dublin, Belfast, Lerwick, Kirkwall and Inverness. In each case, we ensured that there were academic speakers from a local university and also speakers from local business or civil society. The type of partnership proved extremely valuable in connecting with audiences. I never presented myself and my colleagues as 'experts', which might suggest that we have access to a form of knowledge denied to the electorate. Rather, we saw our role as that of facilitators, helping the citizens to explore the issues and make up their own minds. It was the contribution of academic knowledge, the practical knowledge of the civil society speakers and the intelligence of the citizens that made up the whole experience. One highlight was the meeting in Lerwick. Although this was attended only by 22 people in addition to the speakers, it was the occasion for an excellent debate among locals about the prospects for the fishing industry. The debate was not as one-sided as previous reporting about the fishing industry might have suggested and resulted in some very realistic conclusions. Another highlight was a meeting in Inverness in collaboration with the University of the Highlands and Islands, which was broadcast through the UHI video-link, bringing in over 120-people from Ayrshire to Shetland. A low point was a meeting in Easterhouse in Glasgow, which attracted no audience at all. This demonstrates once again how difficult it is to reach some communities. I did propose to address this with a programme of bringing in community organisers to Edinburgh to train them and give them the material to do the dissemination in their own communities. The ESRC supplementary funding came too late to bring this fully to fruition, but we did some work in this field. This has allowed us to identify new ways of reaching 'difficult to reach' communities in future research. We are pursuing this in collaboration with our partner institutions. It is difficult to assess the impact of this work but we did ask for assessments of our public meetings. Respondents reported overwhelming that their understanding of the issue had improved. The Centre on Constitutional Change (CCC), in which the grant was held, has raised its profile and is north main source of information on the impact of Brexit on devolution. The PI featured in the Glasgow Herald list of the most influential people in Scotland in 2017, specifically because of his leadership of CCC. In addition, there were stakeholders meetings, with invited audiences, in London, Edinburgh and Dubin and a business briefing in Aberdeen. This is a highly charged issue politically and I would not want to be associated with any particular political outcome. I do believe, however, that I have helped to clarify the role of the devolved governments in Brexit and the impact of Brexit on devolution. The UK Government over time has become more cognisant of this. I was also among those who challenged the meaning of the term "UK Single Market' and the analogy with the European Single Market. The vocabulary has now shifted to "internal market'. This work is by no means finished and we have received additional ESRC funding under UK in a Changing Europe for a study of the repatriation of competences after Brexit. This draws on our experience from the grant reported here and earlier funding under the Future of UK and Scotland programme. Together, they have greatly improved collaboration and exchange between government and civil society and academia. It is worth noting that, despite the controversial nature of the issues we have received not a single complaint about bias, either during the Scottish referendum nor during the Brexit referendum campaigns and their aftermaths. This has helped make us a trusted source of information and analysis. Since last submission I have completed a paper for the Welsh Senedd and worked as an official advisor for the Scottish Parliament Culture, Europe and External Affairs Committee. I have participated in events with officials and ministers from Cabinet Office, Foreign Office and Scottish Government. |
