GCRF Inclusive Societies: 'Mediation Model for Sustainable Infrastructure Development' - Scaling up Praxis from Mongolia to Central Asia

Abstract

This project develops a dynamic Mediation Model for Sustainable Infrastructure Development (MMSID) to promote inclusive economic development and social welfare in the context of Chinese mega infrastructure initiatives in Mongolia, Kyrgyzstan and Tajikistan. While large-scale infrastructure projects represent a key mechanism of economic growth and development, they also bring unintended and negative consequences to local populations and environments. These challenges can be compounded by specific regional contexts. This is the case in contemporary Asia where China's One Belt-One Road (OBOR), representing more than £1 trillion in investments, is set to transform societies, economies and landscapes through infrastructure megaprojects. Opaqueness in Chinese procurement rights points to the potential for resource contestation between current rural users and state-driven contracts. This contrasts with standards established by international funders such as IFC, World Bank, ADB and OECD. The speed and scale of OBOR investments present particular social and environmental challenges to China's neighbouring states of Kyrgyzstan, Mongolia and Tajikistan. This includes project siting, use of scarce resources such as water, and land degradation. In addition, these states have limited capacity of national government agencies, weak governance institutions, historically poor inclusion of local populations in development processes, fragile, dryland and mountain environments and the prevalence of Sinophobia. These challenges result in the need to foster trust, transparency and cooperation between stakeholders to maintain social cohesion and ensure inclusive economic development. The need to find a new path which combines economic growth and investment with social inclusion is pressing for political stability in the region.

In collaboration with our 2 international Co-Is based in Mongolia and Central Asia, our project addresses these needs by scaling up a pioneering dispute resolution model developed in Mongolia's mining sector. Based on this local participation and stakeholder engagement experience in Mongolia, the MMSID will be replicable, scalable and applicable to other contexts and countries anticipating large-scale investment in. Our MMSID builds upon research by the Co-I and PDRA in 2016-2017 on complaints mediated by the World Bank's Compliance Advisor Ombudsman in response to conflict over land and water appropriation and degradation at the $12 billion Oyu Tolgoi Mine. This process was led by a multi-stakeholder engagement initiative - Tri-Partite Committee (TPC) - which consisted of local pastoralists, local government and mine management. TPC's success shows great potential to scale up Mongolia's example into a replicable model in Central Asia, where there is a cultural and political affinity to Mongolia. The MMSID will be developed through a mixed-methods and participatory action approach. Appropriate methods, field sites and impact activities, have been chosen with research partners. Beneficiaries include: rural residents, local and national government, business stakeholders, international agencies, development practitioners, local and international academics. The project's 6 stages incorporate focused impact activities aimed to build long-term partnerships alongside capacity building and outputs. MMSID will be applied and disseminated through publications, knowledge exchanges, communication platforms, research uptake activities and extensive interactive trainings. The project advances understanding of infrastructure-induced transformations, encourages effective local business engagement and stresses capacity building for development of more inclusive and robust institutional, legal and regulatory frameworks. Our proposal benefits from ten months of scoping work in Central Asia which ensured research feasibility and co-design of research aims with in-country partners and will foster immediate, effective development of MMSID.

Planned Impact

IMPACT SUMMARY

User communities in the three DAC-listed countries have been identified through preliminary scoping work conducted in the UK and project countries. This proposal incorporates multiple stakeholder perspectives across all stages of the project to develop the MMSID to resolve infrastructure disputes by applying Mongolian praxis to Central Asia. International Co-Is at UCA Kyrgyzstan and IRIM Mongolia and project partners (Aga Khan Foundation, People Centred Conservation, INTRAC, Erdenes OT, Mongolian National Science Foundation) have co-designed research aims and objectives and are beneficiaries of capacity development and research implementation skills.

Stakeholders are: 1) International investment organizations that participate in large-scale infrastructure investments in the region; 2) International development organizations operating in Mongolia, Kyrgyzstan and Tajikistan; 2) Government Agencies such as the Ministries, Authorities and Institutes; 3) Local (provincial and district-level) government agencies and community councils; 4)NGOs and civil society organizations in each DAC country; 5) Local research institutions and universities, other publics interested in rural development; 5) Landowners and rural residents; 6) Companies (including Chinese companies): Erdenes LLC, Oyu Tolgoi, Chinalco, etc

International Co-Is, project partners and our UK advisory committee will a) stress goals and adaptive strategies to meet project objectives and beneficiaries needs, b) review project progress, c) establish model and monitoring indicators, d) ensure the model is scaled up from Mongolia to Central Asia, e) develop and strengthen south-south learning between Mongolia and Central Asia.

Impact activities Include:
Two initial workshops in Mongolia and Kyrgyzstan with core research team, collaborators and key stakeholders.

Training events and materials: a) mentoring, research, fieldwork and writing skills-building for partner and stakeholder staff, b) training events for community level groups, c) materials in local language including introductory booklets, project reports and handbook on mediation and dispute resolution for mega-infrastructure, d) 'train the trainers' events; e) training in participatory theatre research method, f) training in dispute resolution facilitation.

Description The team undertook original research at six mining field sites: three in Mongolia (in Khanbogd, Sukhbaatar and Gurvantes soums) and three in Kyrgyzstan (in Ala-Buka, Naryn and Chatkal). In total 190 interviews and 8 focus groups were conducted in Mongolia, and 304 people participated in the research in Kyrgyzstan (173 interviews and 33 focus groups with 131 participants). In addition, the project has, along with the Mongolian NGO 'Steppes without Borders', established the first working group on the Social Impact Assessment (SIA) of mining in Mongolia. Our joint team has undertaken extensive research and consultation in Ulaanbaatar and rural mining sites and has drafted the first Mongolian SIA guidelines which have been presented to the Government of Mongolia.

This field research has generated significant new knowledge about conflict management, corporate social responsibility, social and environmental impacts of mining, knowledge production and the nature of information sharing on the nature of mining development, corruption, and the impact of mining on livelihoods. The SIA focused research has led to a more nuanced understanding of local decision-making processes (including forms of complaint, contestation and negotiation between mining companies, local governments and local herders), has revealed instances of forced resettlement and intimidation of herders, and provided an in-depth picture into the nature of resettlement and compensation practices of mining companies with regard to local households. These findings are directly relevant to the economic and development and social welfare of these DAC list countries (Mongolia and Kyrgyzstan), in particular the livelihoods of rural pastoralist communities. There has been considerable interest in these research findings both from the Mongolian Ministry of Mining and Heavy Industry, and the Kyrgyz Office of the President and State Committee for Industry, Energy and Subsoil Use.

A significant achievement of the project has been increasing research capacity. The Oxford team has run 10 training sessions in Mongolia and 2 in Kyrgyzstan. Participants at these trainings have been from DAC list countries Mongolia, Kyrgyzstan and Afghanistan and have included university students, academics at a range of career stages, independent researchers, NGO officials and civil servants. Trainings have covered qualitative research methods, academic writing, coding and analysing qualitative data, research ethics and writing research grants. The project also supported a Mongolian member of the research team to attend online training on SIA organized by Community Insights Group and the University of Strathclyde (2020). The training covered methodologies for assessing social impacts of mining and developing mitigating strategies which will be shared with members of the SIA working group in Mongolia, thereby increasing research capacity.

A series of knowledge exchange events have also been held in Mongolia, bringing together representatives of mining companies, government ministries, law firms and NGOs to discuss challenges and opportunities in the mining sector and establishing evidence-based best practices. Of particular note was a workshop on compensation which fostered dialogue between herders affected by mining and mining companies and national legislators.
New research collaborations and networks have been forged with key NGOs working in the mining sector in Mongolia (Steppes without Borders, People Centred Conservation), the Mongolian Ministry of Mining and Mongolian Cabinet Secretariat. In Kyrgyzstan our research findings on the disclosure of mining industry data have played a key role in the implementation of the Open Government Partnership
Exploitation Route Based on our fieldwork conducted in Mongolia and Kyrgyzstan we have worked with the Mongolian Government to initiate a new Policy Impact Group that is using our research findings to formulate new national policy on conflict around mining social impact assessments (SIA), compensation and herder rights. Our project partner Steps without Borders piloted SIA in the context of mineral extraction in mining-affected regions in Mongolia in 2022 and the Social Impact Assessment Methodology was approved by the Government of Mongolia in February 2023. The rules are regulated by the decree of the Government, and the methods are approved by the order of the minister of Ministry of Interior. Steps without Borders will also continue to: increase public awareness about SIA methodologies; engage in advocacy activities through the Mongolian media; work closely with decision-makers in charge of the development of the methodology for SIA. As a direct result of our project, Mongolian team members have established a new NGO 'Mergen Boodii' to continue to develop, enhance and promote the mobile app. They will continue to translate mining-related information and resources into Mongolian; conduct knowledge exchange activities in mining-affected rural areas in Mongolia to ensure that the app remains accessible to herders; regularly update the app based on users' needs.

In Kyrgyzstan findings from our field research on mining related conflict has been used by the Government of the Kyrgyz Republic to inform their implementation of the Open Government Partnership, specifically related to the disclosure of mining industry data. The team continues to work closely with the Government in order to have input into what mining data will be made publicly available and in what format. This includes linking the project mobile app that is under development to the Open Government Partnership in Kyrgyzstan

Description Our project has made a number if contributions to non-academic impacts. Our research has documented how communities in rural Mongolia and Kyrgyzstan lack access to clear and understandable information about mining activities that affect their local environments and livelihoods. A key output and impact of our project has been the development of a mobile app that enables the sharing of information related to mining activities and their impacts on lives and livelihoods. The framework of the app was developed across both the Mongolian and Kyrgyz research teams, and has then been further developed by each team to meet specific national requirements. The app enables local herders, government officials at local and national levels, NGO representatives and mining company representatives to share information regarding mining processes, licensing legislation and the environmental, social and economic impacts of mining activity. Mongolia (DAC list country) - In Mongolia, the app has been named 'Mergen Boodi' after the folk hero of the 'wise hedgehog' who was a source of endless information for those seeking answers. Initial piloting of the Mergen Boodi app (www.mergenboodii.mn) has demonstrated high levels of engagement not only by herders in areas affected by mining activity, but also by local government officials and the Ministry of Mining and Heavy Industry. Work is ongoing by project partners to ensure train a team to update and maintain the app and, based on feedback regarding mobile data limitations in some rural areas, the research team has launched a printed newsletter of the app content in collaboration with EITI Mongolia. The project team has worked with the Mongolian Government and established a new Policy Impact Working Group in January 2020. The group is using the project's case studies to formulate new national policy on social impact assessments. The project team has been assisting the group members with developing their knowledge of international best practices and international law regarding mining operations. The group is led by S. Munkhsuren, Chief of Strategic Management and Coordination in the Cabinet Secretariat. Group members include the Chiefs of Mining and Geology Strategic Management, Natural Resource Management, Environment, Geology and Mining Inspection; advisor of Strategic Management and coordination; Head of Steppes Without Borders NGO and a representative of the Oxford team. Efforts have been made to ensure that the lead of the group and two members are women. In 2020 the project team in Mongolia collaborated with the Mongolian Cabinet office and Government Ministries to develop a set of Social Impact Assessment (SIA) guidelines which can be used as the national legal standard for SIA in the country. Using findings from our project, the SIA guidelines that were developed are tailored to the rural Mongolian context in order to maximize participation from local herders and to adequately account for the traditional mobile pastoralist forms of land use. Workshops were held with government and industry stakeholders in Ulaanbaatar and community stakeholders Dornogovi province in 2021 to present the draft set of guidelines, receive comments and encourage further public engagement on the issue of social impact. Over 130 comments on the draft SIA were received and addressed as part of this process. The SIA guidelines and an accompanying legal gap analysis are being reviewed by the Mongolian Cabinet Office. Over the course of 2021, the team has disseminated information about the SIA guidelines and has continued to work with the Government working group on its approval. A 28 minute video documentary in Mongolian was produced in December 2021 and provides more information about the development of the guidelines for a Mongolian audience. As of December 2021, the Government working group is developing an implementation process for the guidelines in order to better tie current EIA processes with the proposed SIA process. Further capacity building was led by our project partner, Steps without Borders over the course of 2022 and engaged stakeholders at all levels of government. On 8 February 2023, the Mongolian government passed a regulation requiring SIA. A new Mongolian Government Working Group has formed to revise the detailed methodology on how to conduct an SIA. Our project partner from Steps without Borders sits on the working group and is contributing to the further refinement of the methodology in order to make it suitable to all large infrastructure projects. Further plans are underway to collaborate with the IDLO to develop a 3 year training programme on SIA for stakeholders in Mongolia and the wider region. This work addresses Sustainable Development Goals 9 (Industry, Innovation and Infrastructure) and 16 (Peace, Justice and Strong Institutions). Kyrgyzstan (DAC list country) - the findings from our field-research on mining related conflict has contributed to the implementation of the Open Government Partnership in Kyrgyzstan, specifically related to the disclosure of mining industry data. Our findings focus on what rural communities in Kyrgyzstan need in terms of access to information related to mining activities (volume of reserves, extraction, processing and exportation of minerals, employment opportunities, environmental and health impacts, the issuing of mining licences, and reclamation legislation). This contribution has been officially recognised by the Government of the Kyrgyz Republic with an award presented to the project's Kyrgyz partner, the University of Central Asia (https://ucentralasia.org/Resources/Item/2499/EN). The Kyrgyz team, headed by Co-I Toktomushev is finalising the content and design for the Kyrgyz version of the mobile app and are working with relevant stakeholders to prepare for its launch later in 2022. This package of work addresses Sustainable Development Goals 9 (Industry, Innovation and Infrastructure) and 16 (Peace, Justice and Strong Institutions).

Description Drafted a set of legal Social Impact Assessment guidelines for the Government of Mongolia

Impact The Mongolia government has changed its regulations which has a direct impact on how large-scale infrastructure projects, including mining, is developed and governed. The main objective of the Working Group was to design a policy proposal and methodology for social impact assessment (SIA) that is currently absent in Mongolia. Under the revisions of environmental impact assessment (EIA) laws, the Government is obliged to adopt both SIA and HIA procedures by the EIA Law of Mongolia Article 7 (2012), which states that: "The Government shall adopt procedures and methodologies for impact assessment, which shall include issues related to environmental impact assessment, assessment analysis, review and regulation of professional council activities, and social and health impact assessment". We developed, wrote and submitted the SIA guidelines and legal review to the Cabinet Secretariat in December 2020. Over the course of 2021, the team has continued to work extensively to disseminate information about the SIA guidelines and work with the Government working group on its approval. As of 8 February 2021, the Government approved the SIA regulation as a procedure required for all large projects. The SIA detailed methodology is in a process of revision, to expand the 2020 guidelines we wrote, which were specific to the mining sector, to address additional sectors. Currently two members of the Gobi Framework project team are working with the IDLO (International Development Law Organization) to fundraise for and develop a 3 year training programme for government officials and stakeholders in social impact assessment and related human rights aspects of large-scale development (for example, resettlement and compensation processes, land rights etc). The Gobi Framework partner, Steps without Borders, has successfully raised funds from the UNDP in Ulaanbaatar to do capacity building and training on compensation for the Government Working Group.

Results and Impact •Knowledge exchange workshops were organized in Dornogovi province, which is a region heavily affected by mining. Herders, local government officials including land, environmental and social specialists, veterinarians, and representatives from local schools attended. The purpose of the knowledge exchange workshops was to introduce the concept of Social Impact Assessment, share the initial draft of the guidelines and to solicit comments from local stakeholders on how to tailor the guidelines to the particular context of the Mongolian countryside. A key outcome was to receive comments from these stakeholders and in order to further refine and develop the draft SIA methodology

Results and Impact This workshop was organized as an intensive review of the draft SIA guidelines by Mongolian stakeholders and UK experts and academics. Participants discussed draft documents in the morning and worked in groups in the afternoon. This workshop was a case study session for those participants who attended in previous training of SIA and served as an opportunity to contribute to drafting aspects of Mongolia SIA guideline. The outcome of this workshop was to produce revisions for the SIA guidelines which were taken forward by the project team to develop the final draft of the SIA guidelines to be submitted to the Mongolian Government

Seven government officials representing six different divisions from the Mineral Resources and Oil Authority provided comments on the draft SIA, and they sent the draft document to their colleagues to solicit additional comments. The intended purpose of this event was to share the draft SIA and receive comments from key government stakeholders. A key outcome was to receive comments from these stakeholders and in order to further refine and develop the draft SIA methodology.

Results and Impact This workshop included heads of division and specialists from the Ministry of Environment and Tourism and environment NGO leaders. The purpose of the meeting was to understand the process of developing and implementing the EIA law and guidelines from the key stakeholders involved in this process. We wanted to understand the barriers faced by stakeholders in order to anticipate barriers for the approval of SIA in Mongolia. The outcome of the meeting included key advice from experts who had worked on the EIA law, networking and further public engagement with the SIA development process
