The Redistribution of Experience: Justice as Fairness

Abstract

I present a theory of justice that is grounded in reality without recourse to metaphysics or
transcendental ideals. I advance a practice of justice that is ordained by a "redistribution of
experience" whereby normative validity is enshrined by the proper recognition of others'
experience. I blend the practices of voice, intelligibility, recognition, and listening to ground this
process immanently. It relies upon intersubjective discursive judgement to illustrate social sources
of injustice. I set my thesis as a response to John Rawls and conclude with a radical restructuring
of A Theory of Justice that removes any recourse to the metaphysical.
