Abstract
The project examines the impact of Brexit on relationships between the four nations/territories of the UK. Devolution was designed and developed within the context of the EU, and EU membership has been important in easing territorial relationships within the UK. The Brexit process is straining these relationships, and could mark a turning point in the system of multi-level government in the UK.
Politicians often use the family as a metaphor when discussing territorial relationships. This project will draw upon ideas developed by sociologists to study relationships within families as a way of understanding and explaining dynamics in the relationships between governments and territories across the UK. The project aims to identify new tensions, opportunities and constraints. It examines the evolution of formal engagement and decision making between the UK and the devolved governments, but it tests the idea that these are conditioned by more informal interactions and the culture surrounding these. This includes the perceptions key players have about their role and the role of others, and the attitudes and behaviour they display. Relationships are studied in three sets of discussions provoked by Brexit: the UK's approach to EU negotiations; the negotiation and implementation of new trade deals; and the future of the UK 'internal market', which aims to avoid distortions in trade and competition once the UK is no longer subject to EU laws.
The UK's exit from the EU coincides with the 20th anniversary of devolution. Brexit is posing big challenges for devolution, but it also offers an opportunity to reform the ways in which the governments and territories of the UK interact and work together. However, the project contends that opportunities for reform will be limited by five sets of constraints: (i) how the UK as a country, and the roles and responsibilities of its different governments, are understood among key players; (ii) the asymmetry, or unevenness, of devolution and decentralised government, including the lack of a distinctive national voice for England; (iii) pressures from the EU and the international community for the UK to speak with one voice in international negotiations and treaty-making; (iv) party political differences and competition between the UK and devolved governments; and (v) the politics of Scottish independence, especially in light of the expectation that Brexit will be the justification used by the Scottish First Minister to take steps towards a new independence referendum.
The project benefits from a small comparative study of Australia and Canada, as two countries outside of the EU that have wrestled with how to share power between their federal and regional governments. These case studies will pay particular attention to how the territories work together to negotiate and implement trade deals, and to support trade and mobility within each of the countries.

Planned Impact
Brexit has been a daily news item since the 2016 referendum campaign, but neglected in the coverage are its implications for the future of the UK and the political relationships between its constituent parts. This project aims to raise awareness of these effects among governments, parliaments, civil society stakeholders and the public. The Fellow will work closely within the UK in a Changing Europe (UKiCE) team, continuing to raise the programme's profile within the devolved territories. She will also draw upon the networks and experience gained from her six years of knowledge exchange as Co-Director of the Centre on Constitutional Change.
Public engagement will be mainly through enhanced digital communication, including regular short video clips, infographics, and three animated videos, disseminated through the UKiCE and CCC You Tube channels and via Instagram. Videos will be creatively and professionally produced, using the metaphor of the family to help convey the dynamics of intergovernmental and inter-territorial relationships to a wider audience. Analysis will also be provided in regular blogs, reports and briefing papers, all disseminated via the well-established websites, Twitter and Facebook channels of UKiCE and CCC. The Fellow will use regularly offered opportunities to speak at public events, including large scale festivals and small community forums. In addition, the project plans three public events, one in each year of the project. One of these will be an interactive event targeted at young people, with a 'digital takeover' that gives them the opportunity to produce blog and Instagram content following deliberations on the territorial effects of Brexit. Building on extensive experience with the national and international print and broadcast media, and the communications resource of the UKiCE, the fellow will also use frequent media work - both proactively and reactively, in response to press requests - to disseminate project findings and promote the wider programme.
McEwen is already embedded within networks of Ministers, elected members, and senior officials leading on devolution and constitutional reform across Whitehall, the devolved governments and parliaments within the UK. She has earned a reputation among these stakeholders as an authoritative, trusted source on the UK's changing constitution. She will continue to nurture these relationships, offering oral advice, masterclasses, tailored briefing papers, and a private space for governments individually or collectively to subject ideas and proposals to early independent evaluation. She will capitalise on opportunities to deliver devolution training for civil servants, and will continue to promote wider practitioner engagement by connecting officials within her network to academics working on Brexit-relevant research within and beyond the ESRC's Brexit programmes. She will seek new opportunities to provide committee evidence in the UK and the EU, building on her extensive experience in providing advice and testimony to parliamentary committees. The fellowship will also empower the wider professional and policy community, e.g. in business and the voluntary sector, as they seek to adapt to the new challenges Brexit is generating for devolution and multi-level government, by providing briefings, advice, consultancy and CPD/training opportunities.
The fellowship will run at least four practitioner workshops to bring stakeholders and officials from government, parliament and the wider policy community together with academics, including those on other UKiCE/Governance after Brexit projects. The proposed workshops will discuss key themes relevant to the territorial politics of Brexit: (i) UK territorial diversity and EU relations; (ii) devolution and trade; (iii) territorial governance and the internal market; and (iv) Brexit and the politics of independence.

Description | This project examines the relationships between the UK and devolved governments against the backdrop of Brexit, identifying new tensions, opportunities and constraints. The project examines these relationships in three key Brexit spheres: (i) the UK-EU Brexit negotiations that led to the Withdrawal Agreement and the EU-UK Trade and Cooperation Agreement; (ii) the governance of the UK 'internal market'; and (iii) the negotiation and implementation of trade negotiations. Preliminary findings have been generated across all three spheres. The research examined the relative influence of the devolved governments in Brexit negotiations. It found that they had very limited influence over the external dimension of Brexit, i.e. the UK government's approach to and participation in negotiations with the European Union. This was attributed to the weakness in the constitutional authority of the UK's devolved governments, the lack of decision making opportunities within intergovernmental forums, and the increasing political divergences between the UK and devolved administrations. However, drawing on 'soft power' resources, and working collaboratively, the devolved governments were able to shape the domestic preparations for EU withdrawal, especially the impact of legislation on devolved competences. The research also examined closely the internal market legislation passed in the Commons in December 2020, scrutinising how its market access principles affect the policy-making capacity of the devolved governments, as well as the common frameworks programme being negotiated by all four administrations. It concluded that while the UK Internal Market Act does not affect the devolved legislatures law-making powers, it diminishes the ability of their laws to regulate the activities of business organisations and professionals within Scotland and Wales when they have been regulated elsewhere in the UK. The experience has also undermined the joint working that was to lead to the development of 'common frameworks' to replace EU regulations in policy areas that are devolved within the UK. It has also contributed to a significant deterioration of trust between the devolved governments, on the one hand, and the UK government on the other. Some preliminary findings on intergovernmental relationships suggest that they vary significantly depending on which UK government department is engaged. Recently announced reforms to IGR may shape IGR processes, but there remains cultural mistrust and hierarchy that affect relationships. Whilst the UKG-devolved government relationships have deteriorated, the Brexit process has generated strong solidarity and cooperative working between the Scottish and Welsh governments. |
Exploitation Route | The research findings generate understanding within and beyond the academy about the impact of Brexit on devolution and the Union. These are being disseminated in academic publications, conference contributions, webinars, podcasts, blogs, briefing papers and media interviews. We have engaged extensively with parliamentarians and officials, especially in connection to the frameworks programme and the UK internal market legislation to aid their understanding of the meaning and scope of the legislation, how frameworks are agreed and options for their implementation. This has informed the legislative process directly, and helped parliamentary committees conduct inquiries into these issues. I regularly accept interviews with print and broadcast media to comment on relationships between the governments, and the challenges that face the Union, including from Scottish independence. |

Description | The project is ongoing, but it is designed to conduct research and generate impact in real time. Impacts at this stage can be summarised as follows: (i) supporting governments and government bodies: we have worked collaboratively with government to exchange ideas on Brexit developments and help their understanding of the impact of legislation on devolved competences. This included two private workshops with the Scottish Government, a private workshop with the Welsh Government, roundtables with two departments of the UK government, presentations to Cabinet Office, FCDO, and two briefing sessions/workshops with BEIS and the Competitions and Markets Authority. (ii) supporting parliamentarians: the PI has given evidence in the House of Commons, House of Lords, Scottish Parliament and Senedd Cymru on: Brexit negotiations and their effect on devolution and intergovernmental relations; common frameworks; devolution after Brexit; and the UK Internal Market legislation (UKIM). This informed committee recommendations and, along with a co-authored briefing paper on UKIM, informed contributions of parliamentarians during the legislative process. She was cited 5 times during debates in the Bill in the House of Commons and House of Lords. Her evidence to the Lords Constitution Committee was cited 8 times in the committee's final report, whilst the Lords Common Frameworks Scrutiny committee cited her evident to it 7 times. Her evidence to the Scottish Parliament Constitution, Europe, External Affairs and Culture Committee's UK Internal Market Inquiry was cited 25 times in its report. (iii) Media engagement. The PI has given regular interviews to the UK and international media on challenges to the Union. She also participated in the Guardian and FT podcasts, an event with the Spectator, and a film produced by the Economist. She was guest expert analyst during BBC Scotland's flagship coverage of the Scottish elections in 2021, reaching an audience of 1.91 million individuals in Scotland - close to half of all adults 16+ (45%) - across broadcasts on BBC One Scotland and BBC Scotland. (iv) Public engagement: Covid-19 has accelerated digital public engagement, informing the public about the effects of Brexit on devolution and the Union. This has included: user-friendly blog posts and report contributions; participation in the UK in a Changing Europe podcast; the setting up of a new podcast, 'Constitutionally Sound', run by the PI and her research fellow; a series entitled 'the Basics', designed to explain key features of the constitution to young people and those seeking access to the debates; and regular digital briefings on topics including the Brexit deal, the UK internal market legislation, and the independence debate. |
